TITLE  OF  BILL:    An  act  to  amend  chapter 55 of the laws of 2009
enacting the transportation, economic  development  and  environmental
conservation  budget  for the 2009-2010 state fiscal year, in relation
to reducing the metropolitan transportation  authority  administrative
expenditures

PURPOSE OR GENERAL IDEA OF BILL: This bill reduces the amount of money
appropriated   for   the   metropolitan   transit  authority  for  its
headquarters and administrative expenditures and re-appropriates those
monies to the MTA reduced fare for school children program.

SUMMARY OF SPECIFIC PROVISIONS: This bill would amend  chapter  55  of
the laws of 2009 enacting the transportation, economic development and
environmental  conservation  budget for the 2009-10 state fiscal year,
in relation to reducing the MTA administrative expenditures.

JUSTIFICATION:   While the  MTA  asserts  it  needs  $214  million  in
additional  state  and  city  aid  to  preserve  reduced student fares
program, program, the actual cost of free and discounted student fares
is close to zero.  The legislature rejects the  MTA's  assertion  that
the  program  must be valued at the ostensible lost revenue, and point
out that state and city funding for the program actually  exceeds  the
cost of providing the service.

There  is currently a $14 million difference between current levels of
funding and the level of funding available to the  MTA  for  the  past
fifteen  years,  during  which  time  MTA  leadership  did not use the
program as a negotiating tool as  it  sought  more  funding  from  the
State.  Instead  of  trying to bridge that gap, and instead of pricing
actual cost of the program, the MTA has made a completely unacceptable
demand for as much as $214 million, without which it will not  restore
the  reduced  student  fares  program.  It  is that tactic that can be
easily described as using  students  as  a  pawn  in  the  attempt  to
increase MTA funding.

The  human  impact  of  the  proposal  to  eliminate  this  program is
unacceptable. The consequences to children and  working  families  are
too  hurtful,  too  important,  and  too  unnecessary to allow this to
continue.

As an emergency response to this unfortunate impact,  the  legislature
will.   statutorily   enforce  a  reduction  of  $14  million  in  MTA
headquarter and administrative expenditures  with  the  revenue  being
used  to  restore  state funding for the student travel program to its
historic levels.

PRIOR LEGISLATIVE HISTORY: New Bill

FISCAL IMPLICATIONS FOR STATE AND  LOCAL  GOVERNMENTS:    $14  million
dollars  would  be  re-allocated  within  the MTA budget in efforts to
preserve the MTA reduced fare for school children program.

EFFECTIVE DATE: This act shall take place immediately.

AN ACT to amend chapter 55 of the laws of 2009 enacting the  transporta-

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The legislature hereby determines that during the 2009-2010
fiscal year, the sum of money appropriated to the metropolitan transpor-
tation  authority  for  their  operating expenses was erroneously calcu-
lated. As such, the metropolitan transportation authority was  appropri-
ated   unnecessary   money   for  its  headquarters  and  administrative
expenditures. As such, the legislature has determined that  this  excess
money  would  be  better  suited to help offset the costs of the reduced
fare for school children program.
  S 2. Section 1 of chapter 55 of the laws of 2009 enacting  the  trans-
portation,  economic  development  and environmental conservation budget
for the 2009-2010 state fiscal year, as amended by chapter  502  of  the
laws  of  2009, is amended by repealing the items herein below set forth
in brackets and by adding to such section the other items underscored in
this section.

  state comptroller, the chairperson of  the
  senate  finance  committee  and the chair-
  person of  the  assembly  ways  and  means
  committee.  Moneys appropriated herein may
  be made available at such times as  deemed
  appropriate  by the commissioner of trans-
  portation and the director of the budget .
