BILL NUMBER:A10587 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing the issuance of distinctive license plates to members of a community emergency response team PURPOSE OR GENERAL IDEA OF BILL: To authorize the Commissioner of Motor Vehicles to issue distinctive license plates to active members of a community emergency response team. SUMMARY OF SPECIFIC PROVISIONS: Section one of the bill amends the Vehicle and Traffic Law by adding a new § 404-x which authorizes the Commissioner of Motor Vehicles to issue distinctive license plates to active members of a community emergency response team. The member to whom the plate is issued would be required to pay an annual service charge of 525 in addiction to the regular registration fee, and the Commissioner of Motor Vehicles skill retain the authority not to issue such plates if he is not satisfied that the annual service charges will recover the costs of the design and manufacture of the plates. JUSTIFICATION: Thousands of men and women in the state of New York dedicate their time and resources to serve as part of the Community Emergency Response Team (CERT), a program that is dedicated to assisting emergency response agencies. The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE PLATES FOR MEMBERS OF A COMMUNITY EMERGENCY RESPONSE TEAM. 1. ANY MEMBER OF A COMMUNITY EMERGENCY RESPONSE TEAM SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEARING THE EMBLEM AND WORDS "C.E.R.T. MEMBER." APPLICATION FOR SAID LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE, AND SHALL BE VERIFIED ANNUALLY BY THE APPLICANT. 2. THE DISTINCTIVE PLATE AUTHORIZED IN SUBDIVISION ONE OF THIS SECTION SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT IS PRESENTLY AN ACTIVE MEMBER OF A COMMUNITY EMERGENCY RESPONSE TEAM. 3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE AND AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS. 4. NOTHING CONTAINED HEREIN SHALL REQUIRE THE ISSUANCE OF A SPECIAL NUMBER PLATE UNDER THIS SECTION UNLESS THE COMMISSIONER IS SATISFIED THAT THE AGGREGATE AMOUNT OF ANNUAL SERVICE CHARGES COLLECTED PURSUANT TO SUBDIVISION THREE OF THIS SECTION WILL BE SUFFICIENT TO RECOVER THE COSTS OF THE DESIGN AND MANUFACTURE OF SUCH SPECIAL NUMBER PLATES.
