BILL NUMBER:A10643 TITLE OF BILL: An act to amend the general business law, in relation to the sale of alcoholic beverages at customer-operated point-of-sale stations PURPOSE OR GENERAL IDEA OF BILL: Prohibits the sale of alcoholic bever- ages by licensed retail establishments at customer-operated point-of- sale stations; fine of $500-$1000 for violation. SUMMARY OF SPECIFIC PROVISIONS: The general business law is amended by adding a new section, 399-eee. JUSTIFICATION: Customer-operated point-of-sale stations, although convenient, have become the means by which under age (21) persons have been purchasing alcoholic beverages. This bill is designed to curtail the sale of alcohol to persons under the age of 21 PRIOR LEGISLATIVE HISTORY: A10149 of 2006; A5593 of 2008; A3943 of 2009 FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

MONTESANO -- read once and referred to the Committee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the general business law, in relation to the sale of alcoholic beverages at customer-operated point-of-sale stations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 399-eee to read as follows: S 399-EEE. PROHIBITED SALE OF ALCOHOLIC BEVERAGES AT CUSTOMER-OPERATED POINT-OF-SALE STATIONS. 1. SALE OF ALCOHOLIC BEVERAGES BY RETAIL ESTAB- LISHMENTS LICENSED PURSUANT TO THE ALCOHOLIC BEVERAGE CONTROL LAW IS PROHIBITED AT CUSTOMER-OPERATED POINT-OF-SALE STATIONS. 2. FOR PURPOSES OF THIS SECTION, "CUSTOMER-OPERATED POINT-OF-SALE STATION" MEANS A SELF-SCANNING CHECKOUT WHERE CUSTOMERS PAY FOR AND BAG THEIR OWN MERCHANDISE WITHOUT INTERACTING WITH A HUMAN CASHIER. 3. VIOLATION OF THIS SECTION SHALL BE SUBJECT TO A FINE OF NO LESS THAN FIVE HUNDRED DOLLARS AND NO MORE THAN ONE THOUSAND DOLLARS. S 2. This act shall take effect immediately.
