BILL NUMBER:A10788 TITLE OF BILL: An act to amend the penal law, in relation to establish- ing the crime of repeat minor offender PURPOSE: OF THE BILL: This bill will increase the penalty for persons who repeatedly commit misdemeanor crimes. SUMMARY OF PROVISIONS: Section one of the bill establishes the crime of repeat minor offender when he or she commits a crime or has previously been convicted of 3 separate class A misdemeanors or 5 class B misdemea- nors. Repeat minor offender is a class E felony. JUSTIFICATION: Petty criminals who repeatedly violate misdemeanor laws continue to get off without any serious consequences. There has been a concerning rise in misdemeanors while felonies in New York State have declined. In New York State since 2002 misdemeanor arrests have increased by 17% and felony arrests have decreased. These repeat offen- ders bog down our courts and cause problems to our communities through petty yet damaging violations. Many prosecutors are backlogged with hundreds of misdemeanor cases. This bill would increase the penalties for offenders who repeatedly ignore the law and charge them with a class S felony. PRIOR LEGISLATIVE HISTORY: New Bill.

ZEBROWSKI -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the crime of repeat minor offender THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 270.40 to read as follows: S 270.40 REPEAT MINOR OFFENDER. 1. A PERSON IS GUILTY OF BEING A REPEAT MINOR OFFENDER WHEN HE OR SHE COMMITS A CRIME AS DEFINED IN THIS CHAPTER AND HE OR SHE HAS BEEN PREVI- OUSLY CONVICTED OF EITHER: (A) THREE SEPARATE CLASS A MISDEMEANORS, OR (B) FIVE SEPARATE CLASS B MISDEMEANORS, WITHIN THE PAST EIGHTY-FOUR MONTHS. 2. FOR THE PURPOSES OF DETERMINING WHETHER A PERSON HAS COMMITTED THIS CRIME, NO TWO MISDEMEANORS MAY ORIGINATE FROM THE SAME CRIMINAL INCI- DENT. REPEAT MINOR OFFENDER IS A CLASS E FELONY. S 2.
