AN  ACT to amend the penal law, in relation to the offense of assault in
  the second degree in certain instances

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 120.05 of the penal law is amended by adding a new
subdivision 13 to read as follows:
  13. WITH INTENT TO CAUSE PHYSICAL INJURY  TO  ANOTHER  PERSON  WHO  IS
EMPLOYED  BY  A  SCHOOL  DISTRICT  OR  BOARD  OF COOPERATIVE EDUCATIONAL
SERVICES AND IS ENGAGED IN A POSITION REQUIRING SUPERVISION OR  INSTRUC-
TION  OF  STUDENTS,  SUCH PERSON CAUSES PHYSICAL INJURY TO SUCH EMPLOYEE
WHETHER HE OR SHE IS OR IS NOT ENGAGED IN SUCH SUPERVISION  OR  INSTRUC-
TION AT THE TIME SUCH INJURY IS CAUSED.
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
