BILL NUMBER:A11091 TITLE OF BILL: An act to amend the domestic relations law, in relation to prohibiting the suspension of driving privileges for veterans who are in support arrears PURPOSE OR GENERAL IDEA OF BILL: This bill would prohibit the suspension of driving privileges for veterans who are in child support arrears. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill would add a new paragraph (iv) to Section 1244-b of the domestic relations law, as amended by chapter 398 of the laws of 1997, that exempts military veter- ans who are in child support arrears from having their driving privi- leges suspended. JUSTIFICATION: Veterans of our nation's armed services face unique chal- lenges, especially once they are discharged from active duty service. Specifically, our veterans may need to access governmental services as well as medical services. Many of our veterans choose to reside in our state's rural communities. In many parts of our state the services our veterans need to access require traveling considerable distances, and there are virtually no public transportation options. Maintaining driv- ing privileges will enable our veterans to access the benefits and services they need and deserve, and which are afforded to them by virtue of the sacrifice they have made for our country.

RUSSELL -- read once and referred to the Commit- tee on Judiciary AN ACT to amend the domestic relations law, in relation to prohibiting the suspension of driving privileges for veterans who are in support arrears THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (iii) of subdivision (c) of section 244-b of the domestic relations law, as amended by chapter 398 of the laws of 1997, is amended and a new paragraph (iv) is added to read as follows: (iii) respondents whose income as defined by subparagraph five of paragraph (b) of subdivision one-b of section two hundred forty of this chapter remaining after the payment of the current support obligation would fall below the self-support reserve as defined by subparagraph six of paragraph (b) of subdivision one-b of section two hundred forty of this chapter[.]; OR (IV) RESPONDENTS WHO ARE VETERANS. AS USED IN THIS PARAGRAPH, THE TERM "VETERAN" MEANS A PERSON, MALE OR FEMALE, RESIDENT OF THIS STATE, WHO HAS SERVED IN THE ACTIVE MILITARY OR NAVAL SERVICE OF THE UNITED STATES DURING A WAR IN WHICH THE UNITED STATES ENGAGED AND WHO HAS BEEN RELEASED FROM SUCH SERVICE OTHERWISE THAN BY DISHONORABLE DISCHARGE, OR WHO HAS BEEN FURLOUGHED TO THE RESERVE.
