AN ACT to amend the  environmental  conservation  law,  in  relation  to
  providing  for  a study of integrated pest management of state facili-
  ties

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  33-0101 of the environmental conservation law is
amended by adding a new subdivision 27-a to read as follows:
  27-A. "INTEGRATED PEST MANAGEMENT" MEANS  A  SUSTAINABLE  APPROACH  TO
MANAGING PESTS THAT RELIES ON:
  A.  THE  EMPLOYMENT OF PHYSICAL, MECHANICAL, CULTURAL, BIOLOGICAL, AND
EDUCATIONAL TACTICS TO CONTROL CONDITIONS  THAT  PROMOTE  PEST  INFESTA-
TIONS, TO KEEP PEST POPULATIONS AT TOLERABLE DAMAGE OR ANNOYANCE LEVELS,
AND TO MINIMIZE THE OVERALL USE OF OR RELIANCE ON PESTICIDES;
  B.  THE APPLICATION OF AN INTERCONNECTED SET OF PRINCIPLES AND METHODS
TO PROBLEMS CAUSED BY INSECTS, VERTEBRATES,  WEEDS,  AND  DISEASES  THAT
ATTACK  PLANTS INCLUDING, BUT NOT LIMITED TO, GENERAL EDUCATION ON INTE-
GRATED PEST MANAGEMENT FOR WORK SITE EMPLOYEES, TECHNICAL  TRAINING  FOR
EMPLOYEES  DIRECTLY  INVOLVED  IN  PREMISES  MANAGEMENT,  AND THE PROPER
CLEANING/MAINTENANCE, HANDLING, AND DISPOSAL OF FOOD AND  ORGANIC  WASTE
PRODUCTS;
  C.  THE  USE,  TO  THE MAXIMUM EXTENT FEASIBLE, OF ALTERNATIVES TO ANY
PESTICIDE CLASSIFIED AS A KNOWN, LIKELY,  PROBABLE,  OR  POSSIBLE  HUMAN
CARCINOGEN BY THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY; AND
  D.  THE ELIMINATION OF THE USE OF ANY PESTICIDE CLASSIFIED AS TOXICITY
CATEGORY I OR II BY THE UNITED STATES ENVIRONMENTAL  PROTECTION  AGENCY,
EXCEPT WHERE NECESSARY TO ADDRESS AN ACUTE HUMAN HEALTH EMERGENCY.

AN ACT to amend the  environmental  conservation  law,  in  relation  to
  providing the definition of integrated pest management

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 33-0101 of the environmental  conservation  law  is
amended by adding a new subdivision 27-a to read as follows:
  27-A.  "INTEGRATED  PEST  MANAGEMENT"  MEANS  A SYSTEMATIC APPROACH TO
MANAGING PESTS THAT UTILIZES A DIVERSITY OF MANAGEMENT OPTIONS TO  MINI-
MIZE HEALTH, ENVIRONMENTAL AND ECONOMIC RISKS AND IMPACTS. THESE OPTIONS
MAY INCLUDE BIOLOGICAL, CULTURAL, PHYSICAL AND CHEMICAL TOOLS TO PREVENT
PEST INFESTATIONS OR REDUCE THEM TO ACCEPTABLE LEVELS.
  S 2. This act shall take effect immediately.
