AN ACT to amend the public service law, in relation to mandating various
  levels of biodiesel blend in residential heating oil

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public service law is amended by adding a new section 6
to read as follows:
  S 6.  STANDARDS FOR CERTAIN RESIDENTIAL HEATING OIL. THE  COMMISSIONER
SHALL  REQUIRE  RESIDENTIAL  HEATING OIL CONSIST OF A BLEND OF BIODIESEL
FUEL AT THE FOLLOWING LEVELS:
  1.  FOR  JANUARY  FIRST,  TWO   THOUSAND   ELEVEN   THROUGH   DECEMBER
THIRTY-FIRST, TWO THOUSAND ELEVEN, FIVE PERCENT BIODIESEL BLEND;
  2.   FOR   JANUARY   FIRST,   TWO  THOUSAND  TWELVE  THROUGH  DECEMBER
THIRTY-FIRST, TWO THOUSAND TWELVE, TEN PERCENT BIODIESEL BLEND;
  3. FOR JANUARY FIRST, TWO THOUSAND  THIRTEEN  AND  THEREAFTER,  TWENTY
PERCENT BIODIESEL BLEND.
  S  2.  Section  2 of the public service law is amended by adding a new
subdivision 1-a to read as follows:
   1-A. THE TERM "BIODIESEL BLEND", WHEN  USED  IN  THIS  CHAPTER  MEANS
RENEWABLE,  BIODEGRADABLE,  MONO  ALKYL  ESTER  COMBUSTIBLE  LIQUID FUEL
DERIVED FROM AGRICULTURAL PLANT OILS OR ANIMAL FATS.
  S 3. This act shall take effect immediately.

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

TRIAL) HEATING OIL. THE COMMISSIONER SHALL REQUIRE  RETAIL  HEATING  OIL
CONSIST OF A BLEND OF BIODIESEL FUEL AT THE FOLLOWING LEVELS:
  1.   FOR   JANUARY   FIRST,   TWO  THOUSAND  ELEVEN  THROUGH  DECEMBER
THIRTY-FIRST, TWO THOUSAND ELEVEN, FIVE PERCENT BIODIESEL BLEND;
  2.  FOR  JANUARY  FIRST,  TWO   THOUSAND   TWELVE   THROUGH   DECEMBER
THIRTY-FIRST, TWO THOUSAND TWELVE, TEN PERCENT BIODIESEL BLEND;
  3.  FOR  JANUARY  FIRST,  TWO THOUSAND THIRTEEN AND THEREAFTER, TWENTY
PERCENT BIODIESEL BLEND.
