AN ACT to amend the vehicle and traffic law, in relation to requiring
that persons who are under eighteen years of age and charged with a
traffic violation must appear in court with a parent or guardian
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The vehicle and traffic law is amended by adding a new
section 229 to read as follows:
S 229. APPEARANCES BY MINORS. ANY PERSON WHO IS LESS THAN EIGHTEEN
YEARS OF AGE AND WHO IS CHARGED WITH VIOLATING A PROVISION OF THIS CHAP-
TER MAY NOT MAKE ANY COURT APPEARANCE UNLESS HE OR SHE IS ACCOMPANIED BY
HIS OR HER PARENT OR LEGAL GUARDIAN. SUCH PERSON MAY NOT MAKE AN APPEAR-
ANCE BY MAIL. IF SUCH PERSON IS REPRESENTED BY AN ATTORNEY, SUCH PERSON
AND HIS OR HER PARENT OR GUARDIAN MUST ACCOMPANY THE ATTORNEY TO EACH
AND EVERY COURT APPEARANCE.
S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law, provided that the commissioner of motor
vehicles is immediately authorized and directed to promulgate, amend
and/or repeal any rules and regulations necessary to implement the
provisions of this act on its effective date.
