AN ACT to amend the environmental conservation law, in relation to mold

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The environmental conservation law is amended by  adding  a
new article 32 to read as follows:
                                ARTICLE 32
                            MOLD REMEDIATION
SECTION 32-0101. MOLD REMEDIATION CERTIFICATION.
        32-0102. CERTIFICATION REQUIRED.
        32-0103. CERTIFICATION AND REGISTRATION FEES.
S 32-0101. MOLD REMEDIATION CERTIFICATION.
  1.  ANY  PERSON  WHO  ENGAGES  IN COMMERCIAL MOLD REMEDIATION SHALL BE
CERTIFIED BY THE COMMISSIONER. NO CERTIFICATION SHALL  BE  VALID  UNLESS
THE  CERTIFIED  PERSON  ALSO HOLDS A VALID IDENTIFICATION CARD ISSUED BY
THE COMMISSIONER.
  2. A. APPLICATION FOR MOLD REMEDIATION CERTIFICATION SHALL BE MADE  TO
THE  COMMISSIONER.  THE APPLICATION SHALL BE ON A FORM PRESCRIBED BY THE
COMMISSIONER AND SHALL BE ACCOMPANIED BY THE FEE  OR  FEES  PROVIDED  IN
SECTION 32-0103 OF THIS ARTICLE.
  B. AN APPLICANT FOR CERTIFICATION SHALL SATISFY THE COMMISSIONER AS TO
HIS  OR HER KNOWLEDGE AND EXPERIENCE CONCERNING MOLD, THE CAUSE OF MOLD,
AND PROPER MOLD REMEDIATION  PROCEDURES  THROUGH  EXAMINATION  PRIOR  TO
INITIAL CERTIFICATION. RECERTIFICATION SHALL BE BY TRAINING, WORKBOOK OR
EXAMINATION AS REQUIRED BY THE COMMISSIONER.
  C.  UPON  CERTIFICATION,  THE COMMISSIONER SHALL CERTIFY THE APPLICANT
FOR THE APPROPRIATE CATEGORY OF CERTIFICATION AND SHALL ISSUE A  CERTIF-
ICATION  IDENTIFICATION  CARD  TO  THE  APPLICANT. THE CERTIFICATION MAY

        32-0106. MOLD REMEDIATION CONTRACTOR; LICENSING REQUIREMENTS.
        32-0107. MINIMUM  WORK PRACTICES AND PROCEDURES FOR MOLD ASSESS-
                   MENT.
        32-0108. MINIMUM WORK PRACTICES AND PROCEDURES FOR MOLD  REMEDI-
                   ATION.
        32-0109. POST-REMEDIATION ASSESSMENT AND CLEARANCE.
        32-0110. DUTY OF PROPERTY OWNER.
        32-0111. COMPLIANCE; INSPECTIONS AND INVESTIGATIONS.
