MILLER -- Multi-Sponsored by -- M. of A. SAYWARD -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to tutoring of students who have missed school due to illness THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3205 of the education law is amended by adding a new subdivision 4 to read as follows: 4. WHERE A STUDENT IS ABSENT FROM SCHOOL DUE TO ILLNESS, SUCH STUDENT SHALL BE PROVIDED WITH ALTERNATIVE TUTORIAL SERVICES IN THE SAME TIME FRAME AS SUCH INSTRUCTION IS GIVEN TO STUDENTS WHO ARE ABSENT DUE TO SUSPENSION, AS PROVIDED IN SECTION THIRTY-TWO HUNDRED FOURTEEN OF THIS ARTICLE. A STUDENT ABSENT DUE TO ILLNESS MAY BE EXEMPTED FROM SUCH INSTRUCTION IF HIS OR HER PHYSICIAN DEEMS IT TO BE ADVISABLE. ANY ADDI- TIONAL COSTS INCURRED BY A SCHOOL DISTRICT FOR ALTERNATIVE TUTORIAL SERVICES REQUIRED BY THIS SUBDIVISION SHALL BE REIMBURSED BY THE DEPART- MENT. S 2.
