AN  ACT to amend the election law, in relation to tally notification for
  affidavit ballot voters

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The election law is amended by adding a new section 8-313
to read as follows:
  S 8-313. TALLY NOTIFICATION FOR VOTERS CASTING  AN  AFFIDAVIT  BALLOT.
1.  THE  BOARD OF ELECTIONS SHALL NOTIFY IN WRITING ANY PERSON WHO VOTED
IN A GENERAL OR SPECIAL ELECTION BY AFFIDAVIT BALLOT AS  TO  WHETHER  OR
NOT  THEIR VOTE WAS EVENTUALLY TALLIED.  IF SUCH VOTES WERE NOT TALLIED,
SUCH NOTIFICATION MUST PROVIDE AN EXPLANATION.
  2. NOTIFICATION MUST BE PROVIDED NO LATER THAN NINETY DAYS  AFTER  THE
BOARD  OF  ELECTIONS  HAS  CERTIFIED  THE WINNERS FOR ALL OFFICES ON THE
BALLOTS.
  S 2. This act shall take effect immediately.
