Authorizes local municipalities to regulate towing companies, including the establishment of minimum insurance levels, the licensing and regulation of persons engaged in the business of towing, and the fixing of maximum charges made for the towing and storage of vehicles; such regulation applies to consensual and non-consensual tows.

AN ACT to amend the vehicle and traffic law, in relation to  authorizing
  local municipalities to regulate towing companies

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision (a) of section 1640 of the vehicle and  traffic
law is amended by adding a new paragraph 23 to read as follows:
  23.  REGULATE  THE  TOWING AND PUSHING OF VEHICLES, INCLUDING, BUT NOT
LIMITED TO, THE  ESTABLISHMENT  OF  MINIMUM  INSURANCE  LEVELS  FOR  THE
LICENSING  AND  REGULATION OF PERSONS ENGAGED IN THE BUSINESS OF TOWING,
AND THE FIXING OF MAXIMUM CHARGES TO BE MADE BY  SUCH  PERSONS  FOR  THE
TOWING  AND  STORAGE OF VEHICLES. SUCH REGULATION SHALL APPLY TO, BUT IS
NOT LIMITED TO, CONSENSUAL AND NON-CONSENSUAL TOWING OF VEHICLES.   NON-
CONSENSUAL  TOWS  SHALL INCLUDE, BUT ARE NOT LIMITED TO, ANY TOWS FROM A
HIGHWAY, STREET OR ADJACENT AREA REQUIRED BY A LAW  ENFORCEMENT  OFFICER
OR  LAW ENFORCEMENT AGENCY WHEN THE ARRANGEMENTS WITH THE TOWING COMPANY
ARE MADE BY SUCH OFFICER OR BY SUCH ENFORCEMENT AGENCY, OR ANY TOWS FROM
PRIVATE PROPERTY WHEN THE ARRANGEMENTS WITH SUCH TOWING COMPANY ARE  NOT
MADE BY THE OWNER OR OPERATOR OF THE VEHICLE THAT IS TO BE TOWED.
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law.
