Directs the commissioner of social services to implement a policy whereby the department shall not make multiple monthly payments for rental housing costs attributable to unrelated public assistance recipients residing at the same residence or address, so as to pay more than twenty percent above the fair market rental value of such single-family housing; provides certain exemptions.

AN ACT to amend the social services law, in relation to  certain  public
  assistance payments

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision (i) of section 17 of the social  services  law,
as relettered by section 1 of part K3 of chapter 57 of the laws of 2007,
is relettered subdivision (j) and a new subdivision (i) is added to read
as follows:
  (I)  INSTITUTE  A  SYSTEM TO TRACK PUBLIC ASSISTANCE PAYMENTS TO UNRE-
LATED PUBLIC ASSISTANCE RECIPIENTS RESIDING IN  THE  SAME  SINGLE-FAMILY
RESIDENCE; AND SHALL IMPLEMENT A POLICY WHEREBY THE DEPARTMENT SHALL NOT
MAKE  MULTIPLE MONTHLY PAYMENTS FOR RENTAL HOUSING COSTS ATTRIBUTABLE TO
UNRELATED PUBLIC ASSISTANCE RECIPIENTS RESIDING AT THE SAME RESIDENCE OR
ADDRESS, SO AS TO PAY MORE THAN TWENTY PERCENT  ABOVE  THE  FAIR  MARKET
RENTAL  VALUE OF SUCH SINGLE-FAMILY HOUSING; PROVIDED, HOWEVER, THAT ANY
RESIDENTIAL CARE FACILITIES THAT PROVIDE  HOUSING  TO  THE  DISABLED  OR
MENTALLY ILL PURSUANT TO ARTICLE THIRTY-ONE OF THE MENTAL HYGIENE LAW OR
ASSISTED LIVING RESIDENCES PURSUANT TO ARTICLE FORTY-SIX-B OF THE PUBLIC
HEALTH LAW SHALL BE EXEMPT FROM THE PROVISIONS OF THIS SUBDIVISION.
  S 2. This act shall take effect immediately.
