AN ACT in relation to the death benefit payable to the widow of Garry L.
  Veeder

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any provision of law to the contrary, Donna
Veeder, the widow of Garry L. Veeder, shall be hereby eligible to change
the  date  of  retirement  of  her  husband, who was employed as a state
police forensic scientist 3, to April 30, 2008,  if  she  shall,  on  or
before  December  31,  2009, file a written request with the state comp-
troller electing to receive such benefit.  Any retirement benefits to be
received due to the change in date of  retirement  of  Garry  L.  Veeder
shall be offset by any retirement benefits already received by his bene-
ficiary.
  S 2. Any costs associated with the implementation of this act shall be
borne by the state of New York.
  S 3. This act shall take effect immediately.
  FISCAL NOTE.-- Pursuant to Legislative Law, Section 50:
  This bill would deem Garry L Veeder, who died May 23, 2008 and who had
previously  filed  an  application  to  retire with a service retirement
effective May 30, 2008, to have retired with  a  service  retirement  on
April  30,  2008.  Donna  Veeder,  the widow of Garry L Veeder, would be
entitled to a lifetime pension and a  lump  sum  post  retirement  death
benefit.  This would be paid in lieu of the ordinary death benefit which
has already been paid.
  If this bill is enacted, there would be a one-time cost to  the  State
of  New  York  of  approximately $413,000. This estimate is based on the
assumption that payment will be made on March 1, 2010.
  This estimate, dated March 26, 2009, and intended for use only  during
the  2009  Legislative  Session, is Fiscal Note No. 2009-135 prepared by
the Actuary for the NYS & LERS.
