AN ACT to amend the social services law, in relation to requiring the
provision of transportation services to recipients of medical assist-
ance for the purpose of transporting eligible recipients of medical
assistance from their residences to a safe location during the
provision of extermination or pest control services, and to subse-
quently return such recipients to their residence after completion of
such services
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 1 of section 365-h of the social services law,
as added by chapter 81 of the laws of 1995, is amended to read as
follows:
1. The local social services official shall have responsibility for

FOR eligible persons and for limiting the provision of such transporta-
tion SERVICES to those recipients and circumstances where: (A) such
transportation is essential, medically necessary and appropriate to

obtain medical care, services or supplies otherwise available under this
title; OR (B) SUBJECT TO FEDERAL PARTICIPATION, SUCH TRANSPORTATION IS
UTILIZED TO TRANSPORT A RECIPIENT OF MEDICAL ASSISTANCE FROM HIS OR HER
RESIDENCE TO A SAFE LOCATION DURING THE PROVISION OF EXTERMINATION OR
PEST CONTROL SERVICES, AND TO SUBSEQUENTLY RETURN SUCH RECIPIENT TO HIS
OR HER RESIDENCE AFTER COMPLETION OF SUCH SERVICES, WHEN SUCH TRANSPOR-
TATION IS DEEMED MEDICALLY NECESSARY TO ENSURE SAFE TRANSPORT OF THE
RECIPIENT TO THE SAFE LOCATION.
S 2. This act shall take effect on the first of January next succeed-
ing the date on which it shall have become a law; provided that effec-
tive immediately, the addition, amendment and/or repeal of any rule or
regulation necessary for the implementation of this act on its effective
date are authorized and directed to be made and completed on or before
such effective date.
