AN ACT to repeal section 2 of part X-1 of chapter 57 of the laws of 2009
  amending the tax law relating to taxes on beer and wine under  article
  18  of  the  tax  law,  relating  to a floor tax on beer and wine; and
  providing for the refund of certain taxes paid under such article 18

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  2  of part X-1 of chapter 57 of the laws of 2009
amending the tax law relating to taxes on beer and wine under article 18
of the tax law is REPEALED.
  S 2. The commissioner of taxation and finance shall  upon  application
refund all moneys received by such commissioner for the payment of taxes
pursuant to section 2 of part X-1 of chapter 57 of the laws of 2009.
  S  3.  This  act  shall take effect immediately and shall be deemed to
have been in full force and effect on and after May 1, 2009.

  taxes paid under such article 18

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivisions (b), (c) and (e) of section 2 of part X-1 of
chapter 57 of the laws of 2009 amending the tax law relating to taxes on
beer and wine under article 18 of the tax law are REPEALED.
  S 2. The commissioner of taxation and finance shall  upon  application
