AN ACT to amend the public health law, the state  finance  law  and  the
  insurance  law,  in  relation to the development of comprehensive care
  centers for autism spectrum disorders

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new article
27-M to read as follows:
                              ARTICLE 27-M
                       COMPREHENSIVE CARE CENTERS
                      FOR AUTISM SPECTRUM DISORDERS
SECTION 2799-T.  LEGISLATIVE FINDINGS.

                   DERS; ESTABLISHED.
        2799-W.  QUALIFYING CRITERIA.
        2799-X.  STATE  IDENTIFICATION OF COMPREHENSIVE CARE CENTERS FOR
                   AUTISM  SPECTRUM  DISORDERS;  COMMISSIONER'S  WRITTEN
                   NOTICE.
        2799-Y.  RESTRICTED USE OF TITLE.
        2799-Z.  RESEARCH.
        2799-AA. RESIDENTIAL  CARE  PROGRAMS  PROVIDED  BY COMPREHENSIVE
                   CARE CENTERS.
        2799-BB. COMPREHENSIVE CARE CENTER DEVELOPMENT GRANTS.
  S 2799-T. LEGISLATIVE FINDINGS.  THE  LEGISLATURE  HEREBY  FINDS  THAT
EFFECTIVE  DIAGNOSIS  AND  TREATMENT FOR CITIZENS STRUGGLING WITH AUTISM
DISORDERS,  A  COMPLEX  AND  POTENTIALLY   LIFE-THREATENING   CONDITION,
REQUIRES  A CONTINUUM OF INTERDISCIPLINARY PROVIDERS AND LEVELS OF CARE.
SUCH EFFECTIVE DIAGNOSIS AND TREATMENT FURTHER REQUIRES THE COORDINATION

AN ACT to amend the public health law, in relation to the development of
  autism assessment centers

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new article
27-M to read as follows:

SECTION 2799-T. LEGISLATIVE FINDINGS.
        2799-U. DEFINITIONS.
        2799-V. COMPREHENSIVE AUTISM ASSESSMENT CENTERS ESTABLISHED.
        2799-W. STATE IDENTIFICATION AND  DEVELOPMENT  OF  COMPREHENSIVE
                  AUTISM ASSESSMENT CENTERS.
        2799-X. REPORTING/RESEARCH REQUIREMENTS.
  S  2799-T.  LEGISLATIVE  FINDINGS.  THE  LEGISLATURE FINDS THAT AUTISM
SPECTRUM DISORDERS (ASD) ARE LIFELONG,  NEURODEVELOPMENTAL  DISABILITIES
THAT  INCLUDE  AUTISM,  PERVASIVE DEVELOPMENTAL DISORDER - NOT OTHERWISE
SPECIFIED (PDD-NOS), AND ASPERGER SYNDROME.  EACH  OF  THESE  CONDITIONS
SHARES  SOME  OF THE SAME CHARACTERISTICS; HOWEVER, THEY DIFFER IN ONSET
OF SYMPTOMS, SEVERITY OF SYMPTOMS, AND THE NATURE OF THE SYMPTOMS. THESE
CONDITIONS ALONG WITH CHILDHOOD DISINTEGRATIVE DISORDER (CDD)  AND  RETT
SYNDROME  CONSTITUTE  THE  BROADER  CATEGORY  OF PERVASIVE DEVELOPMENTAL
DISORDER. THERE IS NO MEDICAL TEST TO DIAGNOSE ASD, INSTEAD A  DIFFEREN-
TIAL DIAGNOSIS IS MADE ON THE BASIS OF OBSERVATION AND ASSESSMENT OF THE
CHILD AS WELL AS AN INTERVIEW PROCESS WITH THE CAREGIVER OR CAREGIVERS.
  THE  LEGISLATURE  FURTHER FINDS THAT ASDS OCCUR IN ALL RACIAL, ETHNIC,
AND SOCIOECONOMIC GROUPS AND ARE FOUR TIMES  MORE  LIKELY  TO  OCCUR  IN

AN ACT to amend the public health law, in relation to the development of
  autism assessment centers

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2822 to read as follows:
  S 2822. AUTISM ASSESSMENT CENTERS.  1. THE LEGISLATURE FINDS THAT  THE
DRAMATIC  INCREASE  IN  THE  PREVALENCE  OF  INDIVIDUALS IDENTIFIED WITH
AUTISM SPECTRUM DISORDERS (ASP) AND OTHER COMPLEX DEVELOPMENTAL DISABIL-
ITIES REPRESENTS A SIGNIFICANT CHALLENGE IN ENSURING THE PROPER  ASSESS-
MENT  AND  DEVELOPMENT  OF  APPROPRIATE INDIVIDUALIZED INTERVENTIONS FOR
CHILDREN WITH SEVERE MANIFESTATIONS  OF  ASD.    THE  SEVERE,  PERVASIVE
NATURE OF THESE DISABILITIES IS MANIFESTED NOT ONLY IN DEVELOPMENTAL AND
BEHAVIORAL  PROBLEMS, BUT IN THE MORE SEVERE CASES, PHYSICAL SYMPTOMS AS
WELL. PRESENTING CHARACTERISTICS OF  INDIVIDUALS  WITH  AUTISM  SPECTRUM
DISORDERS  AND COMPLEX DISABILITIES INCLUDE SOCIAL AND COGNITIVE IMPAIR-
MENT; LANGUAGE DISTURBANCES; PROBLEMS WITH  ATTENTION  AND  SELF-REGULA-
TION;  REPETITIVE,  STEREOTYPED,  AGGRESSIVE,  SELF-INJURIOUS BEHAVIORS;
AND, OFTEN COMPLEX AND SEVERE CASES CO-OCCURRING WITH MEDICAL CONDITIONS
SUCH AS SEIZURE AND SLEEP DISORDERS; AND, PSYCHIATRIC AND HEALTH  CONDI-
TIONS SUCH AS FRAGILE X SYNDROME AND TUBEROUS SCLEROSIS.
  FOR  THESE REASONS, THE LEGISLATURE DECLARES THAT THE ESTABLISHMENT OF
NEW SHORT-TERM BEHAVIORAL AND ASSESSMENT INTERVENTION UNITS  TO  PROVIDE
FOR  THE  ASSESSMENT  AND INTERVENTION FOR CHILDREN WITH SEVERE FORMS OF
ASD IS NECESSARY. THE ACCURATE ASSESSMENT OF INDIVIDUALS WITH ASD IS THE
FIRST STEP IN DEVELOPING APPROPRIATE PROGRAMS  FOR  THESE  CHILDREN  AND

AN ACT to amend the public health law, in relation to the development of
  comprehensive autism assessment centers

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subdivision 1 of section 2801 of the public health law, as
separately amended by chapters 297 and 416  of  the  laws  of  1983,  is
amended to read as follows:
  1.  "Hospital"  means a facility or institution engaged principally in
providing services by or under the supervision of a physician or, in the
case of a dental clinic or dental dispensary,  of  a  dentist,  for  the
prevention,  diagnosis  or  treatment  of  human  disease, pain, injury,
deformity or physical condition, including, but not limited to, a gener-
al hospital, public health center, diagnostic center, treatment  center,
dental  clinic,  dental  dispensary,  rehabilitation center other than a
facility used solely for vocational rehabilitation, nursing home, tuber-
culosis hospital, chronic disease hospital, maternity  hospital,  lying-
in-asylum,  out-patient  department, out-patient lodge, dispensary and a
laboratory or central service facility serving one or more  such  insti-
tutions, A COMPREHENSIVE AUTISM ASSESSMENT CENTER, but the term hospital
shall  not  include an institution, sanitarium or other facility engaged
principally in providing  services  for  the  prevention,  diagnosis  or
treatment  of  mental  disability  and which is subject to the powers of
visitation, examination, inspection and investigation of the  department
of  mental  hygiene  except  for those distinct parts of such a facility
