BILL NUMBER:A9109 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing the issuance of distinctive plates for recipients of the distinguished service cross medal PURPOSE: Authorizes the issuance of distinctive license plates for individuals who receive the Distinguished Service Cross. SUMMARY OF PROVISIONS: The vehicle and traffic law is amended to authorize the department of motor vehicles to create a distinctive license plate for service members who Received the Distinguished Service Cross Award. JUSTIFICATION: The Distinguished Service Cross is the second highest military decoration of the United States Army. It is awarded to a person who, while serving in any capacity with the Army, distinguished himself or herself by extraordinary heroism not justifying the award of the Medal of Honor; while engaged in an action against an enemy of the United States; while engaged in military operations involving conflict with an opposing or foreign force; or while serving with friendly foreign forces engaged in an armed conflict against an opposing Armed Force in which the United States is not a belligerent party. The act or acts of heroism must have been so notable and have involved risk of life so extraordinary as to set the individual apart from his or her comrades. TOWNSEND -- read once and referred to the Commit- tee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing the issuance of distinctive plates for recipients of the distinguished service cross medal THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE PLATES FOR PERSONS AWARDED THE DISTINGUISHED SERVICE CROSS MEDAL. 1. ANY PERSON WHO WAS A RECIPIENT OF THE DISTIN- GUISHED SERVICE CROSS MEDAL OR THE SPOUSE OF ANY SUCH PERSON SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEARING THE WORDS "DISTINGUISHED SERVICE CROSS". IF A DISTINCTIVE PLATE IS ISSUED TO A PERSON PURSUANT TO THIS SECTION, SUCH A DISTINCTIVE PLATE SHALL NOT BE ISSUED TO THE SPOUSE OF SUCH PERSON. APPLICATION FOR SAID LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. THE DISTINCTIVE PLATE AUTHORIZED IN SUBDIVISION ONE OF THIS SECTION SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT OR THE SPOUSE OF THE APPLICANT IS A RECIPIENT OR THE SPOUSE OF THE RECIPIENT WHO RECEIVED THE DISTINGUISHED SERVICE CROSS, PURSUANT TO 10 USC 3742. 3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE PROVIDED, HOWEVER, THAT AN ADDITIONAL ONE TIME SERVICE CHARGE OF TEN DOLLARS SHALL BE CHARGED FOR SUCH PLATE. SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-OO OF THIS ARTICLE TO THE CREDIT OF THE DEPARTMENT OF MOTOR VEHI- CLES DISTINCTIVE PLATE DEVELOPMENT FUND ESTABLISHED BY SECTION EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
