BILL NUMBER:A9135 TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to requiring verbal warnings to be issued prior to the issuance of a parking violation PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to require a verbal warning to any occupied vehicle before a parking control or enforcement agency in the City of New York can issue a parking violation summons. SUMMARY OF PROVISIONS: This bill will add a new Section 19-162.3 to the administrative code of the City of New York to require a verbal warning to the occupant of a vehicle prior to the issuance of a parking violation JUSTIFICATION: Before issuing a parking violation to an occupied vehicle, a traffic agent or other law enforcement authority should be required to verbally direct the suspected vehicle to move immediately or they will be given a parking violation summons. Recent examples illustrate the need for such a common sense approach to traffic enforcement, including where a motorist was given a "no parking" ticket while sitting in his car after pulling to the curb to take a phone call, and where a motorist was given a ticket for "double parking" while waiting for another car to pull out of a parking space. COOK, LANCMAN -- read once and referred to the Committee on Transportation AN ACT to amend the administrative code of the city of New York, in relation to requiring verbal warnings to be issued prior to the issu- ance of a parking violation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 19-162.3 to read as follows: S 19-162.3 VERBAL WARNING PRIOR TO PARKING VIOLATION. NO MOTOR VEHI- CLE, OCCUPIED BY ONE OR MORE PERSONS, SHALL BE ISSUED A PARKING VIOLATION UNLESS A VERBAL WARNING HAS FIRST BEEN ISSUED BY A MEMBER OF THE POLICE DEPARTMENT, FIRE DEPARTMENT, THE DEPARTMENT OF TRANSPORTATION OR ANY OTHER OFFICER DESIGNATED WITH THE AUTHORITY TO ISSUE SUCH VIOLATIONS BY THE PARKING VIOLATIONS BUREAU.
