BILL NUMBER:A9206 TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibitions on the use of firearms near a dwelling PURPOSE OR GENERAL IDEA OF BILL: Increases the distance from a dwelling in which a firearm or long bow may be discharged. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Subparagraph 2 of paragraph a of subdivision 4 of section 11-0931 of the environmental conservation law is amended; and Section 2. Subparagraphs 1 and 4 of paragraph b of subdivision 4 of section 11-0931 of the environmental conversation law are amended. JUSTIFICATION: Under current law, hunters are prohibited from discharg- ing a firearm or long bow within 500 feet of a house dwelling and other locations such as schools and playgrounds. This bill would increase that setback to 1,000 feet to further ensure the safety of children and adults near their homes and schools. PRIOR LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None to state. EFFECTIVE DATE: This act shall take effect immediately.

THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibitions on the use of firearms near a dwelling THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 2 of paragraph a of subdivision 4 of section 11-0931 of the environmental conservation law is amended to read as follows: (2) discharge a firearm or long bow within [five hundred] ONE THOUSAND feet from a dwelling house, farm building or farm structure actually occupied or used, school building, school playground, or occupied facto- ry or church; S 2. Subparagraphs 1 and 4 of paragraph b of subdivision 4 of section 11-0931 of the environmental conservation law are amended to read as follows: (1) The owner or lessee of the dwelling house, or members of his imme- diate family actually residing therein, or a person in his employ, or the guest of the owner or lessee of the dwelling house acting with the consent of said owner or lessee, provided however, that nothing herein shall be deemed to authorize such persons to discharge a firearm or longbow within [five hundred] ONE THOUSAND feet of any other dwelling house, or a farm building or farm structure actually occupied or used, or a school building or playground or occupied factory or church; (4) The discharge of a shotgun over water by a person hunting migrato- ry game birds if no dwelling house or public structure, livestock or person is situated in the line of discharge less than [five hundred] ONE THOUSAND feet from the point of discharge.
