BILL NUMBER:A9501 TITLE OF BILL: An act to amend the private housing finance law, in relation to preferences to veterans for rentals and selection of tenants by certain housing companies PURPOSE OR GENERAL IDEA OF BILL: This bill recognizes and honors the service of veterans in Iraq, Afghanistan and other recent conflicts by updating the statutory criteria for providing preferences in admission to Mitchell-Lama housing to veterans and their surviving spouses. SUMMARY OF SPECIFIC PROVISIONS: This bill amends subdivision 7 of §31 of the Private Housing Finance Law to remove the language that currently limits the veteran's preference in admission to "Mitchell Lama" housing to persons and surviving spouses of persons who served in the armed forces of the United States between the dates of February 28, 1961 to May 7, 1975. The eligibility standard is replaced with the broader definition in Civil Service Law §85, which includes all veterans who served in time of war, including those who served in the Persian Gulf war and the continuing conflicts in Iraq and Afghanistan. EFFECTS OF PRESENT LAW WHICH THIS BILL WOULD ALTER: The current time limitations concerning military service qualifying for a veteran's pref- erence for Mitchell-Lama housing would be replaced with the broader and more appropriate definition used in the civil service program.

Subdivision 7 of section 31 of the private housing finance law, as added by chapter 154 of the laws of 1969, the opening paragraph as amended by chapter 650 of the laws of 1976 and paragraph (a) as amended by chapter 179 of the laws of 2006, is amended to read as follows: 7. Preference in admission to a project shall be given by a mutual company or an urban rental company or by the New York state housing finance agency when subleasing dwellings in projects of such companies pursuant to section forty-four-a of this chapter, to persons or surviv- ing spouses of persons who [(a) have served in the armed forces of the United States for a period of at least six months (or any shorter period which terminated due to death or injury incurred in such service), provided some portion of the period of service was between the twenty-eighth day of February, nine- teen hundred sixty-one to the seventh day of May, nineteen hundred seventy-five, and (b) have been thereafter discharged or released therefrom under condi- tions other than dishonorable, or died in such service, not more than five years prior to the time of application for admission to such project] ARE VETERANS AS SUCH TERM IS DEFINED PURSUANT TO SECTION EIGHT- Y-FIVE OF THE CIVIL SERVICE LAW.
