BILL NUMBER:A9514 TITLE OF BILL: An act to amend the education law, in relation to the provision of certain programs and services to private or parochial school pupils PURPOSE OR GENERAL IDEA OF BILL: To allow private or parochial school pupils to participate in inter-school, intramural and extramural athletics, and other extracurricular activities with the consent of the board of education. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Adds a new Education Law section 3204-a to provide that local school districts, except any school districts located in cities having a population of one million or more, shall allow private or parochial school children to participate in extracurricular activities and school athletic programs, upon a written request, to the board of education which is filed prior to June first each year. JUSTIFICATION: Presently, private or parochial school pupils may participate in extracurricular activities and intramural & extramural sports at the discretion of the local board of education, are precluded from participating in interscholastic sports by regulation. However, their families pay real property taxes to financially support such local school district. CAHILL, McENENY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the provision of certain programs and services to private or parochial school pupils THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3204-a to read as follows: S 3204-A. PROVISION OF CERTAIN PROGRAMS AND SERVICES TO PRIVATE OR PAROCHIAL SCHOOL PUPILS. 1. AS USED IN THIS SECTION, THE TERM "PROGRAMS AND SERVICES" SHALL MEAN PARTICIPATION IN ALL EXTRACURRICULAR ACTIV- ITIES, AND INTRASCHOOL, INTRAMURAL, AND EXTRAMURAL ATHLETICS PURSUANT TO REGULATIONS PROMULGATED BY THE COMMISSIONER. 2. THE SCHOOL AUTHORITIES OF ANY SCHOOL DISTRICT AND ANY COMMUNITY SCHOOL DISTRICT IN THE STATE, EXCEPT ANY SCHOOL DISTRICTS LOCATED IN CITIES HAVING A POPULATION OF ONE MILLION OR MORE SHALL FURNISH PROGRAMS AND SERVICES TO PUPILS WHO ARE RESIDENTS OF THIS STATE AND WHO ATTEND PRIVATE OR PAROCHIAL SCHOOLS IN SUCH SCHOOL DISTRICTS, UPON THE WRITTEN REQUEST OF THE PERSONS IN PARENTAL RELATION TO ANY SUCH PUPIL. SUCH A REQUEST SHALL BE FILED WITH THE BOARD OF EDUCATION OF THE SCHOOL DISTRICT IN WHICH THE PERSONS IN PARENTAL RELATION TO ANY SUCH PUPIL RESIDE ON OR BEFORE THE FIRST DAY OF JUNE PRECEDING THE SCHOOL YEAR FOR WHICH THE REQUEST IS MADE. S 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law.
