BILL NUMBER:A9771 TITLE OF BILL: An act to amend the environmental conservation law, in relation to cadmium in children's products PURPOSE OR GENERAL IDEA OF BILL: Prohibits the use of cadmium in chil- dren's products. SUMMARY OF SPECIFIC PROVISIONS: This legislation will add title IV to article 37 of the environmental conservation law. Title IV will prohibit cadmium in children's products. All children's products and components of children's products shall be subject to this title. Exceptions are in place for products manufactured before January of 2010, for products that contain cadmium from recycled materials; provided that the level of cadmium does not exceed forty parts per million, and cadmium that has been recovered and or separated from other materials for uses as a metal or metallic compound. This title shall expire on January 1st 2014. This legislation also requires any manufacturer, distributor or supplier to be able to provide a certificate of compliance stating that a product is in compliance with this title. JUSTIFICATION: The passage of the Consumer Safety Improvement Act of 2008 banned lead in the manufacturing of children toys and jewelry. However, instead of switching to Zinc, a safe metal alternative, manufacturers have been using Cadmium. Cadmium is a known carcinogen, ranks number 7 on the Center for Disease Control's list of 275 most

FIELDS -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to cadmium in children's products THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 37 of the environmental conservation law is amended by adding a new title IV to read as follows: TITLE IV PROHIBITION ON CADMIUM IN CHILDREN'S PRODUCTS SECTION 37-0401. DEFINITIONS. 37-0403. PROHIBITIONS. 37-0405. EXEMPTIONS. 37-0407. CERTIFICATE OF COMPLIANCE. 37-0409. VIOLATIONS. 37-0411. PUBLIC ACCESS. 37-0413. REPORTS. 37-0415. RULES AND REGULATIONS. S 37-0401. DEFINITIONS. FOR THE PURPOSES OF THIS TITLE, THE TERM: 1. "DISTRIBUTOR" SHALL MEAN ANY PERSON, FIRM, ASSOCIATION, PARTNERSHIP OR CORPORATION, WHO TAKES TITLE TO OR POSSESSION OF GOODS OR PURCHASES FOR RESALE OR PROMOTIONAL PURPOSES. 2. "DISTRIBUTION" SHALL MEAN THE PRACTICE OF TAKING TITLE TO OR POSSESSION OF CHILDREN'S PRODUCTS FOR PROMOTIONAL PURPOSES OR RESALE. PERSONS INVOLVED SOLELY IN DELIVERING CHILDREN'S PRODUCTS OR COMPONENTS OF CHILDREN'S PRODUCTS ON BEHALF OF THIRD PARTIES ARE NOT CONSIDERED DISTRIBUTORS. 3. "INCIDENTAL PRESENCE" SHALL MEAN THE PRESENCE OF CADMIUM AS AN UNINTENDED OR UNDESIRED INGREDIENT OF A PRODUCT. 4. "INTENTIONAL INTRODUCTION" OR "INTENTIONALLY INTRODUCED" SHALL MEAN THE ACT OF DELIBERATELY UTILIZING CADMIUM IN THE FORMATION OF A CHIL- DREN'S PRODUCT WHERE ITS CONTINUED PRESENCE IS DESIRED IN THE FINAL PRODUCT TO PROVIDE A SPECIFIC CHARACTERISTIC, APPEARANCE, OR QUALITY. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
