BILL NUMBER:A9891 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting the driving of motor vehicles or motorcycles in bicycle lanes or bicycle paths in a city with a population of one million or more PURPOSE OR GENERAL IDEA OF BILL: To prohibit driving in bicycle lanes and bicycle paths in the city of New York. SUMMARY OF SPECIFIC PROVISIONS: Sec. 1. The vehicle and traffic law is amended by adding a new section 1132 to prohibit the driving in bicycle lanes and bicycle paths unless under the direction of a police officer. Sec. 2 Subdivision (b) of section 1800 of the vehicle and traffic law is amended by adding a new paragraph 3 that establishes a fine of not more than $75 for this infraction and shall not be made part of the operating record of the person cited. JUSTIFICATION: Recently, an elderly, disabled resident of Greenwich Village was run over by a Parks Department garbage truck that was driv- ing in a protected bike lane. The bike lane is protected from moving traffic by a row of parked cars, but the truck was using it. While the victim is recovering slowly from her life-threatening injuries, any citizen in a bicycle lane should have the right to assume that her safe- ty would not be compromised by motor vehicles. GLICK -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to prohibiting the driving of motor vehicles or motorcycles in bicycle lanes or bicy- cle paths in a city with a population of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 1132 to read as follows: S 1132. DRIVING IN BICYCLE LANES OR BICYCLE PATHS PROHIBITED. EXCEPT FOR EMERGENCY OR FIRE VEHICLES, NO PERSON SHALL OPERATE A MOTOR VEHICLE OR MOTORCYCLE IN A BICYCLE LANE OR BICYCLE PATH IN A CITY WITH A POPU- LATION OF ONE MILLION OR MORE. THE FOREGOING LIMITATION SHALL NOT PREVENT MOTOR VEHICLES FROM DRIVING IN BICYCLE LANES OR BICYCLE PATHS WHEN DIRECTED BY POLICE OFFICERS OR FLAGPERSONS. S 2. Subdivision (b) of section 1800 of the vehicle and traffic law is amended by adding a new paragraph 3 to read as follows: 3. NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH ONE OF THIS SUBDIVI- SION, A PERSON CONVICTED OF A TRAFFIC INFRACTION FOR A VIOLATION OF THE PROVISIONS OF SECTION ELEVEN HUNDRED THIRTY-TWO OF THIS CHAPTER SHALL FOR CONVICTION THEREOF, BE PUNISHED BY A FINE OF NOT MORE THAN SEVENTY- FIVE DOLLARS AND SHALL NOT BE MADE PART OF THE OPERATING RECORD OF THE PERSON UPON WHOM SUCH LIABILITY IS IMPOSED NOR SHALL IT BE USED FOR INSURANCE PURPOSES IN THE PROVISION OF MOTOR VEHICLE INSURANCE COVERAGE. S 3. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
