BILL NUMBER:A9906 TITLE OF BILL: An act authorizing the village of Monroe to adopt local laws exempting such village from any regulations that restrict the burn- ing of garbage in open fires in certain circumstances PURPOSE OR GENERAL IDEA OF BILL: To allow a municipality with a popu- lation of 20,000 or less to adopt a local law, ordinance, or resolution which exempts such municipality from any code, rule, regulation or stan- dard that would restrict the burning of garbage, refuse or rubbish and provides for the exemption of open fires on land possessed by a single family or utilized as part of a farm operation, at local option. SUMMARY OF SPECIFIC PROVISIONS: The Village of Monroe may adopt a local law which exempts the village from codes, rules, regulations, or stand- ards that restrict from the burning of garbage, refuse or rubbish in an open fire, even when on land possessed by a single family or any part of a farm on which waste is generated as a result of the operation of the farm. JUSTIFICATION: The current ban on open burning is an extreme hardship for the Village of Monroe as this is the most cost effective manner in which to dispose of brush generated within the Village. RABBITT -- read once and referred to the Commit- tee on Environmental Conservation AN ACT authorizing the village of Monroe to adopt local laws exempting such village from any regulations that restrict the burning of garbage in open fires in certain circumstances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The village of Monroe is hereby authorized and empowered to adopt and amend local laws, ordinances or resolutions which exempt such village from any code, rule, regulation or standard that would restrict the burning of garbage, refuse or rubbish in an open fire. In addition, the village of Monroe is hereby further authorized and empowered to adopt and amend local laws, ordinances or resolutions which exempt such village from any code, rule, regulation or standard that would restrict the burning of garbage, refuse or rubbish in an open fire on land possessed by a single family, a member of which is the owner, occupant, or lessee of said land, or any part of a farm on which waste is gener- ated as a result of the operation of such farm.
