BILL NUMBER: S1293 TITLE OF BILL : An act to amend the correction law, in relation to human immunodeficiency virus (HIV) prevention PURPOSE OR GENERAL IDEA OF BILL : To require correctional facilities to provide inmates with information about the prevention of HIV and inform them of their ability to obtain HIV testing and counseling upon release. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends the correction law by adding a new section 75 to require the state department of correctional services to provide inmates with information about the prevention of HIV and inform them of their ability to get free HIV testing and counseling upon release. Section 2 amends the correction law to require local correctional facilities to provide inmates with information about the prevention of HIV and inform them of their ability to get free HIV testing and counseling upon release. JUSTIFICATION : Correctional facilities have disproportionately high rates infectious diseases, namely HIV and AIDS. Such is evident in the AIDS rate in

The correction law is amended by adding a new section 75 to read as follows: S 75. HUMAN IMMUNODEFICIENCY VIRUS (HIV) PREVENTION. UPON DISCHARGE OF AN INMATE FROM A CORRECTIONAL FACILITY, THE DEPARTMENT SHALL PROVIDE SUCH INMATE WITH EDUCATIONAL INFORMATION ABOUT THE PREVENTION OF HUMAN IMMUNODEFICIENCY VIRUS (HIV) INFECTION, INSTRUCTIONS ABOUT HOW TO OBTAIN FREE HIV TESTING UPON RELEASE, INCLUDING CONTACT INFORMATION FOR HIV COUNSELING AND TESTING SERVICE PROVIDERS LOCATED IN THE COUNTY OR CITY IN WHICH SUCH INMATE INTENDS TO RESIDE UPON RELEASE, AND REFERRALS TO COMMUNITY-BASED HIV PREVENTION, EDUCATION AND COUNSELING RESOURCES LOCATED IN THE COUNTY OR CITY IN WHICH SUCH INMATE INTENDS TO RESIDE UPON RELEASE. UPON DISCHARGE OF AN INMATE FROM A LOCAL CORRECTIONAL FACILITY, THE CHIEF ADMINISTRA- TIVE OFFICER OF SUCH LOCAL CORRECTIONAL FACILITY, OR HIS OR HER DESIG- NEE, SHALL PROVIDE SUCH INMATE WITH EDUCATIONAL INFORMATION ABOUT THE PREVENTION OF HUMAN IMMUNODEFICIENCY VIRUS (HIV) INFECTION, INSTRUCTIONS ABOUT HOW TO OBTAIN FREE HIV TESTING UPON RELEASE, INCLUDING CONTACT INFORMATION FOR LOCAL HIV COUNSELING AND TESTING SERVICE PROVIDERS, AND REFERRALS TO COMMUNITY-BASED HIV PREVENTION, EDUCATION AND COUNSELING RESOURCES.
