BILL NUMBER: S1412 TITLE OF BILL : An act to amend the real property tax law, in relation to the payment of taxes on certain state lands in the town of Ellery, in the county of Chautauqua PURPOSE : The purpose of this bill is to provide for the payment of State aid to the County of Chautauqua, Town of Ellery, Maple Springs Fire Company, and the Bemus Point School District therein, with respect to State lands under the jurisdiction of the Office of Parks, Recreation and Historic Preservation located in the Town of Ellery, in the County of Chautauqua. SUMMARY OF PROVISIONS : Section 532 of the Real Property Tax Law is amended by adding a new subdivision k. JUSTIFICATION : The lands that would be the subject of State aid payments are clearly of a statewide benefit. Situated on the beautiful Chautauqua Lake, Midway Park is recognized as the 15th oldest, continually- operating amusement park in the nation, and one of only five remaining "Trolley Parks." This park, opening for its 108th season this year, is visited and enjoyed by numerous New Yorkers each year. Nevertheless, the

Section 532 of the real property tax law is amended by adding a new subdivision (k) to read as follows: (K) THE PARCEL OF LAND, KNOWN AS MIDWAY PARK, LOCATED IN THE TOWN OF ELLERY, CHAUTAUQUA COUNTY, OWNED BY THE STATE AND SUBJECT TO THE JURIS- DICTION OF THE OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION, EXCLUSIVE OF IMPROVEMENTS ERECTED THEREON. S 2. This act shall take effect immediately and the first payment of state aid shall be based upon assessment rolls completed in 2010.
