BILL NUMBER: S1850
TITLE OF BILL :
An act to amend the education law, in relation to requiring all
teachers to be trained in identifying and responding to asthma
emergencies
PURPOSE :
This legislation seeks to require the training of all teachers for the
purposes of identifying and responding to asthma emergencies. To this
end, the Education Commissioner, working in concert with the Health
Commissioner, is directed to promulgate standards for the training of
teachers in identifying and responding to asthma emergencies in pupils
and other persons. Under this legislation, for the school years
commencing in 2011 or thereafter, no person shall be permitted to
teach unless that person has completed such training.
SUMMARY OF SPECIFIC PROVISIONS :
This legislation amends the education law by adding a new §3001-e that
would require the Education Commissioner, in consultation with the
Commissioner of Health, to promulgate standards for the training of
teachers in identifying and responding to asthma emergencies. The
legislation also states that for school years starting in 2011, no
person shall be permitted to teach unless such person holds a valid
certificate of successful completion of such training. The provisions

AN ACT to amend the education law, in relation to requiring all teachers
to be trained in identifying and responding to asthma emergencies
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The education law is amended by adding a new section 3001-e
to read as follows:
S 3001-E. ASTHMA EMERGENCIES; TRAINING IN IDENTIFICATION AND RESPONSE.
1. THE COMMISSIONER, IN CONSULTATION WITH THE COMMISSIONER OF HEALTH,
SHALL, BY RULES AND REGULATIONS, PROMULGATE STANDARDS FOR THE TRAINING
OF TEACHERS IN IDENTIFYING AND RESPONDING TO ASTHMA EMERGENCIES IN
PUPILS AND OTHER PERSONS. SUCH STANDARDS SHALL SPECIFY MINIMUM LEVELS OF
KNOWLEDGE AND PROCEDURES TO BE FOLLOWED. SUCH STANDARDS SHALL PERMIT
TRAINING TO BE GIVEN BY PERSONS OR ORGANIZATIONS DEEMED QUALIFIED TO DO
SO BY THE COMMISSIONER.
2. FOR SCHOOL YEARS COMMENCING IN TWO THOUSAND ELEVEN OR THEREAFTER,
NO PERSON SHALL BE PERMITTED TO TEACH IN ANY PUBLIC OR NON-PUBLIC SCHOOL
SYSTEM UNLESS SUCH PERSON HOLDS A VALID CERTIFICATE OF SUCCESSFUL
COMPLETION OF A COURSE OF TRAINING THAT MEETS THE REQUIREMENTS OF THE
STANDARDS PROMULGATED BY THE COMMISSIONER. THE PROVISIONS OF THIS SUBDI-
VISION SHALL NOT APPLY TO PERSONS TEACHING SOLELY AS TEMPORARY SUBSTI-
TUTES FOR PERIODS NOT IN EXCESS OF FIVE CONSECUTIVE SCHOOL DAYS.
S 2. This act shall take effect immediately.
