 TITLE OF BILL :
An act to authorize approval of a certain transportation contract of
the Whitehall central school district


 PURPOSE :
To legalize, validate, ratify and confirm actions taken by the
Whitehall Central School District relating to or in connection with a
certain transportation contract for the 2007-2008 school year, which
provided transportation to and from the New York State School for the
Blind in Batavia.

 SUMMARY OF PROVISIONS :
Section one - legalizes, validates, ratifies and confirms actions
taken by the Whitehall Central School District relating to or in
connection with a certain transportation contract for the 2007-2008
school year, which provided transportation to and from the New York
State School for the Blind in Batavia

Section two - the education department is hereby directed to consider
the aforementioned contract for transportation aid as valid and proper
obligations of the Whitehall central school district

Section three - contains the effective date.

 JUSTIFICATION :
Due to a misinterpretation of the state bidding requirements Whitehall
Central School District did not publish the "Bid Notice" for a
transportation contract to Batavia School for the Blind for the
required length of time, for the 2007-08 school year. As a result of
the late request for transportation the "Bid Notice" was advertised
four days between publication and opening of the bid rather then the
required five days. The Whitehall Central School official newspaper is
published once a week on Thursday; therefore the notice was published
on August 30, 2007 and the bids were opened on September 4, with
transportation beginning on September 5. The school district
inadvertently interpreted the law to state that the advertisement had
to appear for five days only, and could be opened on the sixth day. As
a result of this misunderstanding the State Education Department has
denied approval of$50,717 for the 200708 State transportation aid
contract for neglecting to publish one additional day. This
legislation would direct the State Education Department to approve the
transportation aid payment notwithstanding the notice requirement

 LEGISLATIVE HISTORY :
New bill; Similar legislation for the 2006-07 year was signed into law
as Chapter 449 of 2008

 FISCAL IMPLICATIONS :
This legislation would authorize the State Education Department to pay
$50,717 to the Whitehall Central School District.

 EFFECTIVE DATE :
The act shall take effect immediately.

AN ACT to authorize approval of a certain transportation contract of the
  Whitehall central school district

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  All acts done and proceedings heretofore had and taken or
caused to be had and taken by the Whitehall central school district  and
by  all  officers, employees and agents of such school district relating
to or in connection with transportation contract number C260112 for  the
2007-2008 school year, which provided transportation to and from the New
York  state  school  for  the  blind in Batavia, and all acts incidental
thereto  are  hereby  legalized,  validated,  ratified  and   confirmed,
notwithstanding  any  failure  to comply with the contract award, award,
approval and filing provisions of the education law, the general munici-
pal law, any other law or any other statutory authority, rule  or  regu-
lation,  other  than  those  filing provisions defined in paragraph a of
subdivision 5 of section 3604 of the education law, in relation  to  any
omission,  error, defect, irregularity or illegality in such proceedings
had or taken.
  S 2. The education department  is  hereby  directed  to  consider  the
aforementioned contract for transportation aid as valid and proper obli-
gations of the Whitehall central school district.
  S 3. This act shall take effect immediately.
