2009-S2370 (ACTIVE) - Summary

Enacts the New York State Health Plan, a comprehensive system of access to health insurance for New York state residents: provides for administrative structure of the plan, including its status as a public benefit corporation; provides for powers and duties of the governing board, the scope of benefits, payment mechanisms and cost controls; establishes the New York Health Trust Fund which would hold monies from a variety of sources to be used solely to finance the plan; establishes a mechanism to collect plan premium payments (an 8% employer premium and a 2% employee payroll premium, which may be paid by an employer, plus a 9% premium payment on self-employment income)

AN ACT to amend the public health law, the state finance law and the tax
  law, in relation to the establishment of the New York health plan  and
  making  an appropriation to the temporary commission on implementation
  of the New York health plan and providing for the  repeal  of  certain
  provisions upon expiration thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 50 and sections 5000, 5001, 5002 and  5003  of  the
public  health  law  are  renumbered article 80 and sections 8000, 8001,
8002 and 8003 and a new article 51 is added to read as follows:

        5101. SHORT TITLE.

        5104. BOARD OF GOVERNORS.
        5105. POWERS AND DUTIES OF THE BOARD.
        5106. POWERS AND DUTIES OF THE EXECUTIVE DIRECTOR.
        5107. PLAN ELIGIBILITY.
        5108. PLAN BENEFITS.
        5109. PAYMENT FOR SERVICES.
        5110. OUT-OF-STATE PARTICIPATION AND PAYMENTS.
  S 5100. LEGISLATIVE FINDINGS. THE LEGISLATURE FINDS AND DECLARES  THAT
ALL  RESIDENTS  OF  THE  STATE  OF  NEW  YORK  HAVE  THE RIGHT TO HEALTH
SERVICES, YET AN INCREASING NUMBER OF NEW YORKERS ARE UNABLE TO EXERCISE
THIS RIGHT BECAUSE OF A LACK OF HEALTH COVERAGE. NEW YORKERS HAVE  EXPE-
RIENCED  A  RAPID  RISE IN THE COST OF HEALTH CARE IN RECENT YEARS. THIS
INCREASE HAS RESULTED IN A LARGE NUMBER OF  PEOPLE    WHO  HAVE  HAD  TO
