TITLE OF BILL :
An act to amend the highway law, in relation to permitting farm
operations to place advertising and directional signs near state
highways
PURPOSE :
To allow farm operations to place advertising signs near state
highways
SUMMARY OF PROVISIONS :
Amends the highway law to permit farm operations to place advertising
and directional signs near state highways.
JUSTIFICATION :
Signs, indicating the availability of specific products to consumers
and signs that direct those consumers to locations where they can he
acquired, are vital to agricultural business. Many retail farm stands
are located on secondary roads and by allowing farmers to place signs
on land parcels of the farm operation or farm woodland adjacent to
state highways will allow them to direct and attract more consumers to
the availability of their products. Having the ability to better
market New York agricultural products strengthens the farm economy and
the state economy as a whole. Farmers have generally placed signs

AN ACT to amend the highway law, in relation to permitting farm oper-
ations to place advertising and directional signs near state highways
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 88 of the highway law is amended by adding a new
subdivision 13 to read as follows:
13. EXCEPTIONS. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO FARM
OPERATIONS, AS DEFINED IN SUBDIVISION ELEVEN OF SECTION THREE HUNDRED
ONE OF THE AGRICULTURE AND MARKETS LAW, INCLUDING FARM WOODLANDS, AS
DEFINED IN SUBDIVISION THREE OF SECTION THREE HUNDRED ONE OF THE AGRI-
CULTURE AND MARKETS LAW, ADJACENT TO NON-CONTROLLED ACCESS HIGHWAYS AS
DESIGNATED BY SUBDIVISION TWO OF SECTION THREE OF THIS CHAPTER. SIGNS,
DISPLAYS, AND DEVICES MAY NOT ADVERTISE ACTIVITIES WHICH DO NOT CONTRIB-
UTE TO THE FARM OPERATION OR FARM WOODLAND.
S 2. This act shall take effect immediately.
