AN ACT to amend the domestic relations law, in relation to who may adopt
  a person

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  closing  paragraph  of  section  110 of the domestic
relations law, as added by chapter 522 of the laws of 1999,  is  amended
to read as follows:
  It  shall  be  unlawful  to  preclude a prospective adoptive parent or
parents solely on the basis that the adoptor or [adopters] ADOPTORS  has
had,  or  has  cancer, or any other disease. THE PERMANENT IMPAIRMENT OR
INCAPACITATION OF ONE SPOUSE SHALL NOT PRECLUDE A HUSBAND AND WIFE  FROM
ADOPTING  TOGETHER  OR  THE  COMPETENT  SPOUSE FROM ADOPTING AS A SINGLE
PARENT. Nothing herein shall prevent  the  rejection  of  a  prospective
applicant based upon his or her poor health or limited life expectancy.
  S 2. This act shall take effect immediately.
