AN ACT to amend the general business  law,  in  relation  to  preventing
  rental car companies from imposing certain charges on customers' cred-
  it cards

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 391-l of the general business law, as  redesignated
by  chapter 694 of the laws of 1995, is amended by adding a new subdivi-
sion 4 to read as follows:
  4. IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM, PARTNERSHIP, ASSOCIATION
OR CORPORATION ENGAGED IN THE BUSINESS OF  RENTING  MOTOR  VEHICLES  AND
ACCEPTING CREDIT CARDS FOR PAYMENT OF SUCH RENTAL CHARGES TO PROCESS, OR
CAUSE TO BE PROCESSED, A CHARGE UPON A CREDIT CARD OF ANY PERSON RENTING
A  MOTOR  VEHICLE  UNLESS  AND  UNTIL  THE AGREED UPON RENTAL PERIOD HAS
EXPIRED.
  S 2. This act shall take effect immediately.

BLY, DO ENACT AS FOLLOWS:

OR CAUSE TO BE PROCESSED, A BLOCK, PRIOR TO FINAL PAYMENT, ON THE CREDIT
OR DEBIT CARD OF ANY PERSON RENTING A MOTOR VEHICLE  UNLESS  THE  AMOUNT
AND  DURATION OF THE BLOCK IS DISCLOSED TO THE CONSUMER. FOR PURPOSES OF
THIS SUBDIVISION, "BLOCK" SHALL MEAN A TEMPORARY DEBIT, HOLD, RESERVE OR
WITHDRAWAL FROM A LINE OF CREDIT OR AN ACCOUNT ON DEPOSIT AT A FINANCIAL
INSTITUTION.
  S 2. This act shall take effect immediately.
