BILL NUMBER: S361

TITLE OF BILL :
An act to amend the education law, in relation to certain vocational
schools providing licensed practical nurse training


PURPOSE OR GENERAL IDEA OF BILL :
To strengthen the quality of health care in New York State by creating
a vehicle to increase the numbers of licensed practical nurses through
greater opportunity for educational training in the field of nursing.

SUMMARY OF SPECIFIC PROVISIONS :
Amends ยง6453 of the education law to authorize the commissioner to
contract with institutions of vocational education (1) to conduct
approved courses to assist foreign trained nurses to qualify for a
license as a licensed practical nurse, (2) conduct refresher courses
for NYS residents currently licensed as licensed practical nurses but
who are not actively engaged in nursing, and (3) to conduct approved
courses to qualify persons as licensed practical nurses if such
institution certifies medical assistants or patient care technicians.

JUSTIFICATION :
As Americans grow older more and more people will need care,
especially in nursing homes and assisted living centers. In fact,
studies predict that nearly 1,000,000 nurses will be needed by the
year 2010. This number includes both registered nurses and licensed
practical nurses.

Licensed practical nurses work under the direction of a doctor or
registered nurse. Most LPNs provide basic bedside care to patients. In
nursing homes LPNs may also help evaluate the needs of residents and
develop care plans. It is essential that the State take proactive
measures such as this to thwart the impending jeopardy to the quality
of health care available to New York residents. This legislation will
create a real solution in a practical way by authorizing the
commissioner to contract with vocational schools to qualify
individuals as licensed practical nurses.

FISCAL IMPLICATIONS :
The State's expenditure to manage ensuing contracts will be greatly
offset by the savings realized through the strengthening of
preventative and long term care additional licensed practical nurses
will provide.

EFFECTIVE DATE :
This act shall take effect immediately.
