 TITLE OF BILL :

An act to amend the public health law, in relation to requiring the
New York state department of health to develop and post signage
describing the importance of hand hygiene in all restrooms, gymnasiums
and locker rooms located in public and private schools


 PURPOSE :

Provides for the department of health to establish and post signage
outlining the importance of hand hygiene in the restrooms, gymnasiums
and locker rooms in public.

 SUMMARY OF PROVISIONS :

Section 1 of this bill will require the Department of Health to
promulgate rules and regulations establishing signage outlining the
importance of hand hygiene for preventing communicable diseases and
providing for such signage to be posted in a conspicuous place or
places inside restrooms, gymnasiums and locker rooms of all public and
private schools throughout the State.

Section 2 of this bill outlines the typeface requirements for the

signage content. Such content shall outline the guidelines for hand
sanitization and its importance in reducing the outbreak and
transmission of communicable diseases.

 EXISTING LAW :

 JUSTIFICATION :

The organism Staphylococcus aureus is found on many individuals skin
and seems to cause no major problems. According the the CDC, the main
mode of transmission of MRSA is via hands which may become
contaminated by contact with colonized or infected persons; or by b)
colonized or infected body sites of the persons themselves; or c) by
items, or environmental surfaces contaminated with body fluids
containing MRSA. Once MRSA gets inside the body, for instance, under
the skin or into the lungs, it can cause infections such as boils or
pneumonia. Individuals who carry this organism appear totally healthy,
and are considered to be carriers of the organism. According to
information provided by the CDC, individuals can protect themself from
MRSA by practicing good hygiene, including keeping one's hands clean
by washing with soap and water or using an alcohol-based hand
sanitizer and showering immediately after participating in exercise.

AN ACT to amend the public health law, in relation to requiring the  New
  York state department of health to develop and post signage describing
  the importance of hand hygiene in all restrooms, gymnasiums and locker
  rooms located in public and private schools

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 13 of the public health law is amended by adding  a
new title 8-A to read as follows:
                               TITLE VIII-A
               HAND HYGIENE IN PUBLIC AND PRIVATE SCHOOLS
SECTION 1358. HAND HYGIENE IN PUBLIC AND PRIVATE SCHOOLS.
  S 1358. HAND HYGIENE IN PUBLIC AND PRIVATE SCHOOLS. 1. THE COMMISSION-
ER  SHALL  PROMULGATE  RULES  AND  REGULATIONS  (A) ESTABLISHING SIGNAGE
OUTLINING THE IMPORTANCE OF HAND HYGIENE GUIDELINES FOR  THE  PREVENTION
OF COMMUNICABLE DISEASES AND (B) PROVIDING FOR SUCH SIGNAGE TO BE POSTED
IN  A  CONSPICUOUS  PLACE OR PLACES INSIDE THE RESTROOMS, GYMNASIUMS AND
LOCKER ROOMS OF ALL PUBLIC AND PRIVATE SCHOOLS THROUGHOUT THE STATE.
  2. SUCH REGULATIONS SHALL INCLUDE CLEAR AND  CONCISE  LANGUAGE  IN  AT
LEAST TWELVE POINT BOLDFACE TYPE OUTLINING THE GUIDELINES FOR HAND SANI-
TIZATION AND ITS IMPORTANCE IN REDUCING THE OUTBREAK AND TRANSMISSION OF
COMMUNICABLE DISEASES.
  S  2.  This act shall take effect immediately.  Effective immediately,
the addition, amendment and/or repeal of any rule or  regulation  neces-
sary  for  the  implementation  of  this  act  on its effective date are
authorized and directed to be made  and  completed  on  or  before  such
effective date.
