BILL NUMBER: S4805 TITLE OF BILL : An act to authorize the Brocton central school district to repay over a period of six years certain overpayments of state aid PURPOSE : This bill adjusts certain state aid payments to the Brocton central school district so that a $810,893 state aid overpayment may be deducted from future state aid payments made to such school district. SUMMARY OF PROVISIONS : This bill allows for deductions from state aid payments due to the school in the years 2009 until 2014. Each deduction shall be to the sum of one-sixth the total of the excess payment ($810,893). There shall be no interest penalty assessed against the district or collected by the state. JUSTIFICATION : Requiring the Brocton school district to make payment directly back to the school in one collective sum would place extreme fiscal strain upon the district. By allowing repayment from the school's future state aid payments over the next six years, the school will be able to shoulder this financial burden in a more appropriate manner and, thereby, allow the school to maintain its standards of educational quality. PRIOR LEGISLATIVE HISTORY : This is a new bill.

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to authorize the Brocton central school district to repay over a period of six years certain overpayments of state aid THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, state aid payments in the amount of not more than eight hundred ten thousand eight hundred ninety-three dollars ($810,893) made to the Brocton central school district in the 2004-2005 school year, which included excess payments of aid of which the district has been notified, and for which a recovery must be made by the state through deduction of future aid payments, shall be reduced by deducting one-sixth of such excess payments from the payments due to such school district and payable in the month of June in the years 2010, 2011, 2012, 2013, 2014 and 2015; provided, however, there shall be no interest penalty assessed against such district or collected by the state; provided, further that, notwithstanding any other provision of this act, any pending payment of moneys due to such district as a prior year adjustment payable pursuant to paragraph c of subdivision 5 of section 3604 of the education law for aid claims that had been previously paid in excess as current year aid payments and for which recovery of excess payments is to be made pursu- ant to this section, shall be reduced at the time of actual payment by any remaining unrecovered balance of such excess payments, and the remaining scheduled deductions of such excess payments pursuant to this act shall be reduced by the commissioner of education to reflect the amount so recovered.
