  printed to be committed to the Committee on Civil Service and Pensions

AN ACT in relation to deeming medical conditions  developed  by  Stephen
  Hess  following  September  11,  2001  a qualifying world trade center
  condition

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding any other provision of law, Stephen Hess,
who, on January 27, 1997 was appointed to the New York city fire depart-
ment as an emergency medical technician, and who, on September 11, 2001,
was assigned to work at the World Trade Center site as part of a hazard-
ous materials unit and worked at such site on September 11, 2001 and for
days thereafter, and who, in the months following  September  11,  2001,
worked  at  the  Staten  Island landfill, the site where debris from the
World Trade Center site was removed to, and who, as  a  result  of  such
work,  developed  various adverse medical conditions, shall be deemed to
have a qualifying World Trade Center condition, as such term is  defined
in  subdivision  36  of  section 2 of the retirement and social security
law, and accordingly shall be entitled to any  retirement,  pension,  or
accidental disability benefits allowed by law as a result of such condi-
tion,  if, on or before December 31, 2009, he files a written request to
that effect with the comptroller of the city of New York.
  S 2. This act shall take effect immediately.
