BILL NUMBER: S5854 TITLE OF BILL : An act to temporarily freeze state spending for fiscal years 2009-2010, 2010-2011 and 2011-2012 PURPOSE : To enact a temporary freeze on state spending in order to help New York State reduce its debt. SUMMARY OF PROVISIONS : Section 1 states that neither the governor nor the legislature shall act upon any appropriation bills which would authorize an increase in total state spending for the fiscal years 2009-2010, 2010-2011 and 2011-2012. Section 2 allows that an increase in spending can occur in the case of an emergency. In order to increase spending in excess of the limitation provided in subdivision one an emergency must be declared by the governor and such spending must be authorized by a two-thirds vote in both the Assembly and Senate. Section 3 mandates that all revenues in excess of the state spending limitations in these fiscal years shall be deposited into a service fund used to payoff the state debt.

VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to temporarily freeze state spending for fiscal years 2009-2010, 2010-2011 and 2011-2012 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. 1. Notwithstanding any provision of law to the contrary or article 7 of the constitution relating to state finances, the governor shall not submit any appropriation bill or bills, nor shall the legisla- ture act upon any such appropriation bill or supplemental appropriation bill or bills for the support of government which authorize an increase in total state spending for state fiscal years 2009-2010, 2010-2011 and 2011-2012. 2. Upon a finding and declaration of an emergency by the governor, the governor may submit appropriation bills which authorize total state spending in excess of the limitation provided in subdivision one of this section. The legislature shall authorize such spending by attaining a two-thirds vote in both the Assembly and the Senate. 3. In any state fiscal year if total state revenues are in excess of the state spending limitation pursuant to subdivision one of this section, all revenues in excess of such state spending limitation shall be deposited into the debt service fund and shall be used to pay down state debt. 4. Any legislation with fiscal implications passed after the budget for fiscal years 2009-2010, 2010-2011 and 2011-2012 shall be offset with savings derived from existing funds and shall not impose additional costs to the state. 5. For purposes of this section: a. "Total state spending" shall mean all state funds, which shall constitute: (i) general funds, including but not limited to newly imposed tax credits or tax exemptions; (ii) special revenue funds; (iii) EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
