BILL NUMBER: S5895 REVISED 05/19/10 TITLE OF BILL : An act to amend the public authorities law, in relation to authorizing the town of North Hempstead to create a townwide environmental improvement district PURPOSE OR GENERAL IDEA OF BILL : To authorize the Town of North Hempstead to create a town wide environmental conservation improvement district to identify and fund the costs associated with the treatment, management and disposal of the town's solid waste and its by-products, and to undertake, amongst other things, erosion control, flood mitigation and remediation, shoreline protection, groundwater protection and wetlands preservation. SUMMARY OF SPECIFIC PROVISIONS : Authorizes the Town of North Hempstead to create a town wide environmental conservation improvement district to identify and fund the costs associated with the treatment, management and disposal of the town's solid waste and its by-products, and to undertake, amongst other things, erosion control, flood mitigation and remediation, shoreline protection, groundwater protection and wetlands preservation.

JOHNSON -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public authorities law, in relation to authorizing the town of North Hempstead to create a townwide environmental improvement district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2049-e of the public authorities law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING THE PROVISIONS OF ANY OTHER LAW, GENERAL, SPECIAL OR LOCAL, THE TOWN BY RESOLUTION OF THE TOWN BOARD AFTER AT LEAST THIRTY DAYS PUBLIC NOTICE AND A PUBLIC HEARING, IS HEREBY AUTHORIZED TO ESTAB- LISH A TOWNWIDE ENVIRONMENTAL CONSERVATION AND GREEN PROJECT INITIATIVES IMPROVEMENT DISTRICT, ENCOMPASSING ALL REAL PROPERTY WITHIN SUCH TOWN, FOR THE PURPOSES OF ASSISTING THE AUTHORITY IN FULFILLING ITS POWERS AS DESCRIBED IN SECTION TWO THOUSAND FORTY-NINE-D OF THIS TITLE AND MEETING OBLIGATIONS INCURRED IN THE TREATMENT, MANAGEMENT OR DISPOSAL OF THE TOWN POPULATION'S SOLID WASTE AND ITS BY-PRODUCTS, AND TO UNDERTAKE OTHER ENVIRONMENTAL PROJECTS, INCLUDING BUT NOT LIMITED TO, EROSION CONTROL, FLOOD MITIGATION AND REMEDIATION, SHORELINE PROTECTION, GROUND- WATER PROTECTION AND WETLANDS PRESERVATION. THE TOWN BOARD SHALL SERVE AS THE BOARD OF COMMISSIONERS OF SUCH DISTRICT. S 2. This act shall take effect immediately.
