BILL NUMBER: S612 TITLE OF BILL : An act to amend the general business law, in relation to the use of metal bats in little league games PURPOSE : Prohibits any league for individuals under the age of sixteen from allowing its participants to use any bat other than one made from wood. SUMMARY OF PROVISIONS : Section 1 amends the general business law by adding a new section 392-j that prohibits the use of metal bats by leagues, groups, associations, or other entity that operates any baseball league for individuals under the age of eighteen. LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to the use of metal bats in little league games THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 392-j to read as follows: S 392-J. USE OF METAL BATS PROHIBITED. NO LEAGUE, GROUP, ASSOCIATION, OR OTHER ENTITY THAT OPERATES ANY BASEBALL LEAGUE FOR INDIVIDUALS AGE TWELVE OR OLDER, SHALL ALLOW ANY PARTICIPANT TO USE A BASEBALL BAT MADE FROM ANY MATERIAL OTHER THAN WOOD. ANY SUCH LEAGUE, GROUP, ASSOCIATION, OR ENTITY THAT VIOLATES THE PROVISIONS OF THIS SECTION SHALL BE STRICTLY LIABLE FOR ANY DAMAGE ARISING FROM A BASEBALL THAT HAS BEEN STRUCK BY SUCH BAT. ANY INDIVIDUAL WHO BRINGS A CAUSE OF ACTION AGAINST A LEAGUE, GROUP, ASSOCIATION, OR OTHER ENTITY FOR VIOLATING THE PROVISIONS OF THIS SECTION SHALL ALSO BE ENTITLED TO HIS OR HER ATTORNEY'S FEES.
