BILL NUMBER: S6181
TITLE OF BILL :
An act to amend the insurance law, in relation to funding of the
Brooklyn healthworks pilot program and upstate healthworks pilot
program
PURPOSE OR GENERAL IDEA OF BILL :
Increase funding available for the Brooklyn Health Works pilot program
and the Upstate HealthWorks pilot program.
SUMMARY OF SPECIFIC PROVISIONS :
Subsection (t) of section 4327 of the insurance law is amended.
JUSTIFICATION :
Thanks to the legislation passed in 2006 which provides HealthWorks
with a steady stream of subsidy funding through the Healthy New York
Program, enrollment has expanded. However, because of the current
subsidy rates (2006 rates), the program can not meet the demand of the
number of enrollees and will have no choice but, to limit the number
of enrollees or start turning away new businesses, unless additional

AN ACT to amend the insurance law, in relation to funding of the Brook-
lyn healthworks pilot program and upstate healthworks pilot program
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subsection (t) of section 4327 of the insurance law, as
added by chapter 441 of the laws of 2006, is amended to read as follows:
(t) Brooklyn healthworks pilot program and upstate healthworks pilot
program. Commencing on July first, two thousand six, the superintendent
shall access funding from the small employer stop loss fund and the
qualifying individual stop loss fund for the purpose of support and
expansion of the existing pilot program Brooklyn healthworks approved by
the superintendent and for the establishment and operation of a pilot
program to be located in upstate New York. For the purpose of this
subsection, [in no event shall] the amount of funding available SHALL
NOT exceed two percent of the annual funding amounts for the small
employer stop loss fund and the qualifying individual stop loss fund.
THE AMOUNT OF FUNDING AVAILABLE SHALL NOT EXCEED FOUR PERCENT OF THE
ANNUAL FUNDING AMOUNTS FOR THE SMALL EMPLOYER STOP LOSS FUND AND THE
QUALIFYING INDIVIDUAL STOP LOSS FUND.
S 2. This act shall take effect immediately.
