AN  ACT  to amend the retirement and social security law, in relation to
  the retirement rights of the Buffalo professional firefighters associ-
  ation members

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The retirement and social security law is amended by adding
a new section 419 to read as follows:
  S   419.  RIGHTS  OF  BUFFALO  PROFESSIONAL  FIREFIGHTERS  ASSOCIATION
MEMBERS.  NOTWITHSTANDING ANY OTHER PROVISION OF LAW  TO  THE  CONTRARY,
ALL  CURRENT AND FUTURE MEMBERS OF THE BUFFALO PROFESSIONAL FIREFIGHTERS
ASSOCIATION, IAFF LOCAL 282, HIRED PRIOR TO THE EXPIRATION OF  SUCCESSOR
COLLECTIVE  BARGAINING  AGREEMENTS  AND/OR  INTEREST ARBITRATION AWARDS,
SHALL BE ENROLLED IN TIER II PURSUANT TO ARTICLE ELEVEN OF THIS CHAPTER.
ONLY THOSE EMPLOYEES HIRED AFTER A NEW COLLECTIVE  BARGAINING  AGREEMENT
AND/OR INTEREST ARBITRATION AWARD SHALL BE ENROLLED IN A TIER OTHER THAN
TIER II.
  S 2. This act shall take effect immediately.
