AN ACT to amend the public health law,  in  relation  to  requiring  the
  commissioner  of  health  to post information detailing how parents or
  guardians of infants or children can  subscribe  to  the  US  Consumer
  Safety  Product  Commission's  (CSPC)  e-mail  subscription  lists  to
  receive free product recall and safety news by e-mail  from  the  CSPC
  and  requiring the inclusion of such information in maternity informa-
  tion leaflets

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2505-b to read as follows:
  S 2505-B. ACCESS TO PRODUCT RECALL INFORMATION.  1.  THE  COMMISSIONER
SHALL  POST ON THE HEALTH DEPARTMENT'S WEBSITE INFORMATION DETAILING HOW
PARENTS OR GUARDIANS OF INFANTS AND CHILDREN CAN  SUBSCRIBE  TO  THE  US
CONSUMER SAFETY PRODUCT COMMISSION'S (CSPC) E-MAIL SUBSCRIPTION LISTS TO
RECEIVE  FREE  PRODUCT  RECALL  AND SAFETY NEWS BY E-MAIL FROM THE CSPC.
SUCH INFORMATION SHALL BE PROVIDED IN THE TOP SIX LANGUAGES  OTHER  THAN
ENGLISH  SPOKEN IN THE STATE ACCORDING TO THE LATEST AVAILABLE DATA FROM
THE U.S. BUREAU OF CENSUS.
  2. THE COMMISSIONER SHALL MAKE THE INFORMATION DESCRIBED  IN  SUBDIVI-
SION ONE OF THIS SECTION AVAILABLE TO EVERY MATERNAL HEALTH CARE FACILI-
TY  FOR  THE PURPOSE OF INCLUSION OF SUCH INFORMATION BY THE HEALTH CARE
FACILITY IN THE MATERNITY INFORMATION LEAFLET AS  DESCRIBED  IN  SECTION
TWENTY-EIGHT HUNDRED THREE-J  OF THIS CHAPTER.
  3.  EACH  MATERNAL  HEALTH  CARE  FACILITY SHALL PROVIDE THE MATERNITY
INFORMATION LEAFLET, INCLUDING THE  CSPC  SUBSCRIPTION  INFORMATION,  IN
ACCORDANCE  WITH SECTION TWENTY-EIGHT HUNDRED THREE-J OF THIS CHAPTER TO
EACH MATERNITY PATIENT OR TO HER APPOINTED  PERSONAL  REPRESENTATIVE  AT
THE  TIME  OF  PREBOOKING OR TIME OF ADMISSION TO A MATERNAL HEALTH CARE
FACILITY.
  4. FOR PURPOSES OF  THIS  SECTION,  "MATERNAL  HEALTH  CARE  FACILITY"
INCLUDES  HOSPITALS AND FREESTANDING BIRTHING CENTERS PROVIDING PERI-NA-

  S  2803-S.  ACCESS TO PRODUCT RECALL INFORMATION.  1. THE COMMISSIONER
SHALL REQUIRE THAT EVERY HOSPITAL AND BIRTH CENTER PREPARE IN PRINTED OR
PHOTOCOPIED FORM AND DISTRIBUTE AT THE TIME OF PRE-BOOKING OR  ADMISSION
DIRECTLY  TO  EACH  MATERNITY  PATIENT AND, UPON REQUEST, TO THE GENERAL
PUBLIC AN INFORMATIONAL LEAFLET. SUCH LEAFLET SHALL BE DESIGNED  BY  THE
COMMISSIONER  IN  CONJUNCTION  WITH  THE EXECUTIVE DIRECTOR OF THE STATE
CONSUMER PROTECTION BOARD, ON BEHALF OF THE  STATE  CONSUMER  PROTECTION
BOARD,  AND SHALL CONTAIN INFORMATION DETAILING HOW PARENTS OR GUARDIANS
OF INFANTS AND CHILDREN CAN SUBSCRIBE  TO  THE  UNITED  STATES  CONSUMER
PRODUCT SAFETY COMMISSIONS E-MAIL SUBSCRIPTION LISTS TO RECEIVE CONSUMER
PRODUCT RECALL AND SAFETY NEWS BY E-MAIL FROM THE UNITED STATES CONSUMER
PRODUCT  SAFETY COMMISSION AND SUCH OTHER MATERIAL AS DEEMED APPROPRIATE

  S 2. This act shall take effect on the first of  May  next  succeeding
the  date  on  which it shall have become a law; provided, however, that
effective immediately, the addition, amendment and/or repeal of any rule
or regulation necessary for the implementation of this act on its effec-
tive date are authorized and directed to be made and  completed  by  the
commissioner of health on or before such effective date.
