AN ACT to amend the education law, in relation to the levy of real prop-
  erty taxes

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subparagraph 1 of paragraph a of subdivision 16 of section
3602 of the education law, as amended by section 18 of part B of chapter
57 of the laws of 2008, is amended to read as follows:
  (1) "Residential real property tax levy" shall  mean  the  school  tax
levy  imposed on residential property, including condominium properties,
in the year commencing in the calendar  year  two  years  prior  to  the
calendar  year  in  which  the base year began. The final update of such
data shall be reported by the state office of real property tax services
to the commissioner by February fifteenth of the base  year.  The  state
office  of  real property tax services shall adopt regulations as appro-
priate to assure the appropriate collection, classification and  report-
ing  of  such  data for the purposes of paying state aid to the schools.
FOR THE PURPOSES OF STATE AID, SCHOOL DISTRICTS RECEIVING FEDERAL MONIES
PURSUANT TO TITLE VIII OF THE ELEMENTARY AND SECONDARY EDUCATION ACT  OF
1965  (ESEA)  SHALL  UTILIZE  SUCH MONIES WHEN COMPUTING THE RESIDENTIAL
REAL PROPERTY TAX LEVY WITHIN THIS SUBPARAGRAPH.
  S 2. This act shall take effect immediately.

  district  to  utilize  and  include certain federal monies received by
  such district in its calculation of the residential real property  tax
  levy

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Notwithstanding any other provision of law to the contrary,
for the purposes  of  state  aid,  the  Highland  Falls-Fort  Montgomery
Central School District, which receives federal monies pursuant to Title
VIII  of the Elementary and Secondary Education Act of 1965 (ESEA) shall
utilize and include such monies  when  computing  the  residential  real
property  tax levy pursuant to subparagraph 1 of paragraph a of subdivi-
sion 16 of section 3602 of the education law.
  S 2. This act shall take effect immediately.
