BILL NUMBER:S7717 TITLE OF BILL: An act to amend chapter 549 of the laws of 2005 amending the tax law relating to authorizing the county of Herkimer to impose a county recording tax on obligation secured by a mortgage on real property, in relation to the expiration thereof PURPOSE: The purpose of the bill is to extend provisions authorizing Herkimer County to impose an additional mortgage recording tax for two years. SUMMARY OF PROVISIONS: Amends section 2 of chapter 549 of the laws of 2005 to authorize Herkim- er County to enact a mortgage recording tax of twenty-five cents for each one hundred dollars of debt until December 1, 2012. EXISTING LAW: The current authorization expires on December 1, 2010. JUSTIFICATION: The Herkimer County Legislature has requested the introduction of this legislation by Resolution No. 129. LEGISLATIVE HISTORY: Chapter 549 of the laws of 2005.

SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 549 of the laws of 2005 amending the tax law relating to authorizing the county of Herkimer to impose a county recording tax on obligation secured by a mortgage on real property, in relation to the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2 of chapter 549 of the laws of 2005 amending the tax law, relating to authorizing the county of Herkimer to impose a county recording tax on obligation secured by a mortgage on real proper- ty, as amended by chapter 481 of the laws of 2008, is amended to read as follows: S 2. This act shall take effect immediately and shall expire and be deemed repealed on December 1, [2010] 2012. S 2. This act shall take effect immediately.
