BILL NUMBER: S78
TITLE OF BILL : An act in relation to the establishment of a warm
water fish hatchery and research facility
PURPOSE : This bill would provide for the construction and
maintenance of a Lake Erie Research Center and warm water hatchery in
Erie County for studying water quality and related impacts on the
fishery along with producing. and stocking warm water fish to he
introduced into the near-shore water of Lake Erie.
SUMMARY OF PROVISIONS : Authorizes and directs the Commissioner of
the Department of Environmental Conservation to establish and maintain
a Lake Erie Research center and warm water hatchery in Erie County to
review through sound scientific data, the needs for enhancing the
fishery and to stock New York water with warm water species.
JUSTIFICATION : There have been disastrous results from the last few
years of fishing in the near-shore area of Lake Erie. The near-shore
fishery in the eastern basin of Lake Erie suffers major loss of
numbers during spawning due to eastern basin shore storms, ice
scouring, zebra mussels, etc. This fishery protected and enhanced
tourism and the economic vitality of Erie County and affected
municipalities. A put and take fishery can be developed to insure the
commitment of DEC Fisheries to Western New York well into the 21st

AN ACT in relation to the establishment of a warm water fish hatchery
and research facility
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The commissioner of environmental conservation is hereby
authorized and directed to establish and maintain a warm water fish
species hatchery and research facility in the county of Erie for the
purpose of stocking the New York waters of Lake Erie with warm water
fish species. The commissioner of environmental conservation shall
establish such hatchery and research facility in a timely manner to
provide for commencing the stocking of Lake Erie with warm water fish
species on or before August 1, 2009.
S 2. This act shall take effect immediately.
