AN ACT authorizing Sharon Culver Flansburg to file for retroactive
membership in the New York state and local employees' retirement
  system with Tier 1 status

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Notwithstanding any inconsistent provision of law, rule or
regulation, Sharon Culver Flansburg, who was employed by the City of
Hornell during 1971 and 1972 and who for reasons not ascribable to her
own negligence did not become a member of the New York state and local
employees' retirement system on such date and who is currently employed
by the New York State Unified Court System in Rochester and who is
currently a member of the New York state and local employees' retirement
system, shall be deemed to have become a member of such retirement
system as of July 8, 1971, if, on or before December 31, 2010 she shall
file a written request with the comptroller to that effect.
S 2. All past service costs associated with the operation of this act
shall be borne by the state of New York.
S 3. This act shall take effect immediately.
FISCAL NOTE.--This bill would deem Sharon Culver Flansburg, a member
of the New York State and Local Employees' Retirement System, to have
become a member of such system on July 8, 1971, thereby granting her
Tier 1 status. All past employee contributions will be refunded.
If this bill is enacted, we anticipated that there will be an increase
of approximately $2,800 in the annual contributions of the State of New
York for the fiscal year ending March 31, 2011.
In addition to the annual contributions discussed above, there will be
an immediate past service cost of approximately $128,000 which would be
borne by State of New York as a one-time payment.
This estimate, dated June 3, 2010 and intended for use only during the
2010 Legislative Session, is Fiscal Note No. 2010-162, prepared by the
Actuary for the New York State & Local Employees Retirement System.
