BILL NUMBER:A10077 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to the line of demarcation of milk tenure PURPOSE OR GENERAL IDEA OF BILL: To clarify the point at which milk ownership changes hands from producer to processor. SUMMARY OF SPECIFIC PROVISIONS: The agriculture and markets law is amended by adding a new section subdivision 5 to section 257-a. JUSTIFICATION: Dairy farming is a unique business in which the transfer of ownership of the raw product from the cow to the facility where it is turned into finished products has been historically unclear. This legis- lation will ensure that all patties involved are aware of where owner- ship changes hands between milk producer and milk processor. PRIOR LEGISLATIVE HISTORY: New Bill. MAGEE -- read once and referred to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to the line of demarcation of milk tenure THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 257-a of the agriculture and markets law is amended by adding a new subdivision 5 to read as follows: 5. OWNERSHIP OF MILK SHALL PASS FROM THE MILK PRODUCER TO THE MILK PLANT WHEN THE MILK IS PLACED IN THE VEHICLE USED TO TRANSFER IT FROM THE MILK PRODUCER'S FACILITY TO THE MILK PLANT OR COMMINGLED WITH MILK FROM OTHER MILK PRODUCERS.
