BILL NUMBER:A10107 TITLE OF BILL: An act to amend the insurance law, in relation to ambu- lance subscription or membership programs PURPOSE OR GENERAL IDEA OF BILL: This bill legitimizes ambulance subscriptions or membership programs, arrangements in which a person pays an ambulance service an annual fee so that the participant in such a program will not incur any out of pocket expenses if ambulance services are needed. SUMMARY OF SPECIFIC PROVISIONS: Adds new section 1124 to the insurance law, which exempts voluntary ambulance services from the licensing requirements set forth in Article 11 of the insurance law if 1) such a service is available to anyone and 2) the entity or representative of the ambulance subscription notifies the participant that the service provider is not contractually obligated to provide an ambulance every time a participant makes such a request. Furthermore, the participant must acknowledge this qualification in writing prior to paying for such services. JUSTIFICATION: This bill is necessary to legitimize the use of ambu- lance subscriptions and membership programs that are not only helpful and cost-saving for participants, but also constitute an important fund- ing source for volunteer ambulance services.

STIRPE, TOWNSEND -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to ambulance subscription or membership programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The insurance law is amended by adding a new section 1124 to read as follows: S 1124. AMBULANCE SUBSCRIPTION OR MEMBERSHIP PROGRAMS; EXEMPTION. AN AMBULANCE SUBSCRIPTION OR MEMBERSHIP PROGRAM, WHICH PROVIDES THAT FOR PAYMENT OF A SET FEE THAT NO CHARGE SHALL BE IMPOSED FOR UTILIZATION OF ALL OR PART OF A VOLUNTARY AMBULANCE SERVICE, AS DEFINED IN SECTION THREE THOUSAND ONE OF THE PUBLIC HEALTH LAW, MAY BE OFFERED BY THE ENTI- TY PROVIDING SUCH AMBULANCE SERVICE WITHOUT SUCH ENTITY BEING LICENSED UNDER THIS CHAPTER AND WITHOUT SUCH ENTITY BEING SUBJECT TO ANY PROVISIONS OF THIS CHAPTER. PROVIDED, HOWEVER, THAT: (A) PARTICIPATION IN SUCH SUBSCRIPTION OR MEMBERSHIP PROGRAM MUST BE AVAILABLE TO ANY PERSON; AND (B) SUCH ENTITY OR ITS REPRESENTATIVE MUST INFORM A PERSON, AND HAVE SUCH PERSON ACKNOWLEDGE IN WRITING PRIOR TO ANY PAYMENT, THAT THE PROVIDER OF AMBULANCE SERVICE IS NOT CONTRACTUALLY OBLIGATED BY THE TERMS OF THE PROGRAM TO PROVIDE SERVICES EACH TIME A REQUEST FOR SERVICES IS MADE.
